In order to purchase a handgun on the BATF's curios and relics list, does the purchaser have to hold a C&R license? Or can he purchase it through any FFL dealer?
Having a C & R allows you to purchase guns from the C & R list through interstate commerce. You don't need a C & R to purchase from an FFL. It is treated just like any other handgun.
To answer your question, yes. You need to acquire a C&R license to have C&R firearms shipped directly to you. You can still purchase any C&R firearm without a C&R license, but the normal firearms acquisition rules apply. C&R FFL allows you to circumvent the rules and have a firearm shipped directly to you.
I'm in California. I called the Kal DOJ and they said if I buy a C&R handgun over the net that it must go directly to a standard FFL and be processed like any other handgun. The only difference is that it is exempt from the drop safety test.
However, if I hold a C&R license, I can go to a gun show in Nevada, buy a C&R, take immediate delivery, bring it home, and just fill out the paperwork myself. That sounds like a winner.
You can also call them direct. The number is 916-498-5095. It's a direct line (at least it was yesterday) and they'll send you the newest list. I also asked for an application for a C&R license.
