California handgun law questions

Several comments to various posts above...

[*] the person who spoke of himself? or others? buying AR lowers in another state and then bringing 'em into California is certainly asking for trouble (or his friends are) on both Federal and California fronts. AR receivers of just about any brand are banned from import and acquistion by non-FFL+AW permittees. And CA residents are not allowed to buy guns outside of CA - a CA FFL must intervene. Any AW violation in CA can be treated as felony now, and with multiple charges (one per receiver, at least) the penalties can really stack up since importation + possession charges can apply for each AW receiver.

[*] A few months ago at an NRA Members Council dinner meeting, quite a few questions about CA "safe gun" laws came up froma audience, esp. those relating to "importation" from out of state, and home manufacture. The guest speakers were Randy Rossi & Tim Riegert, head & deputy head of CA DOJ Firearms Div. These guys are pretty sharp, both are lawyers, and both have a fair knowledge of firearms.

The questions of home manufacture of a handgun, other than a single-action revolver, came up. (Answer: no, you can't make your own handgun; it has to be safety tested, etc. You might be able to arrange 'prototype testing' prior permit w/DOJ but that's a special instance. Only exception is for SA revolvers w/3" or longer bbls.)

After a lot of 'what-if' questions, Riegert reminded us that despite minor loopholes (at least as perceived by us laymen), courts would strongly follow "legislative intent' - which was to specifically disallow new unsafe handguns in CA, except for the specifically-legislated case of those moving to CA with so-called 'unsafe', off-list guns.

This is essentially similar. Since CA residency is still applicable due to dual residency, and even though AZ purchase is legal, the person under discussion is not 'moving into' CA, but rather just 'importing' an 'unsafe', off-list gun - which is illegal.

it's simple

just move to AZ or NV ...be sure to write newspapers and politicians that your money will be going to America.
