Call 911 or Call Lawyer?

SO I ran across the YT Short that basically says, if you shoot someone in SD, rather than calling 911, call your lawyer. (I think they're assuming you either have a lawyer on retainer or, more likely, have a prepaid legal defense program.) The reason being that you give your statement to your lawyer and he gives your statement to police (after editing, I'm sure) so that what he says can't be used against in you in court.

Not sure I buy that theory. Seems to fly in the face of what Massad Ayoob, John Corriea, et al, have said for years (decades). Would it look bad if your first call was to a lawyer? What do you think?

 
Call anyone you want - as long as you also call in your incident to your local law enforcement... Be open and co-operative but after agreeing to making a statement - advise investigators that you'll need to talk to your attorney (or an attorney if you don't have one...) before you make any statements (and have them present with you at the time you make any statement if desired).

Cooper I share your concern about deviating from Mas's basic advice, However, an add-on I have heard (I think it may have been from Correia or on his video) is, if at all possible, have someone else call 911 while you call your lawyer or support company. Reason given is that the 911 recording (which begins as soon as it starts ringing, not when someone answers) can be used as evidence without your permission. If you have that person to call 911, and it is safe for you both to be on the phone, give them quick instructions what to say, especially that your description is included. When the police do arrive, you can either follow the say nothing guidance, or Ayoob's 5 things to say then lawyer up.
Being sure someone (you or another) first call 911 is to win the 911 race, doing so before your atttacker or a frriend of the attacker. Remember, the cops, and sometimes the prosecutors, generlly feel the first 911 call is the victim.

OK, I just watched the linked video. It was by a criminal defense lawyer who does not say he is a self-defense specialist. And his advice is based on the assumption you already have a local lawyer who is available 24/7. If you are in any of the self-defense support organizations (ACLDN, USCCA, CCWSafe, US Law Shield, LoR, etc.) they are not likely to have one near you they can get there quickly enough).

Call 911 first. That's what an innocent victim would do and you don't want to deviate from that script. It's especially important that you call first if there's any chance at all if someone else might call and give the police a different story. Say the minimum required to get on the record as the victim and to establish the bare facts and then you can start trying to get hold of your lawyer.

Spot on. It’s a crime scene after a shooting and your lawyer should understand and know that…and not interfere. Call 911, report, and add that you are disconnecting to call your lawyer. All 911 calls are recorded, btw. Then contact your lawyer. You already know (hopefully) to otherwise keep your mouth shut until your lawyer appears.
 
Anchorite nailed it--911 first if you can--but I will suggest that you call someone who will keep calling your attorney until contact has been made, particularly if it is one of those "one phone call" situations.

You may not be able to call 911 yourself immediately, if the event is ongoing. Under such such circumstances, ask anoter person to call and to describe you and the perps.
 
I usually don't have a working phone, so the chances of me being the first one to call 911 are slim. Do all of you folks have "your lawyer" for such an event already selected?
 
Call 911 asap. If it is an on going incident, do so as soon as you're able to dial 911, even if you just drop the phone with the operator on the line.

If 911 isn't called or called first, one of the prosecutor's first questions on cross examination will be to ask why it wasn't done.

It's an ongoing incident until the police arrive and say it is not. You do NOT know everything, the alleged bad guys friend just left but back in 30seconds posse'd up. All the while you're piddle-farting with press1 for ?? whoever at the attorneys #.

Your FIRST and primary duty is to ACCESS SAFETY SERVICES and the decades old traditional method of that is yell loudly ''HELP!!''and CALL #911

I'd follow Masaad Ayoob's advice.

I'm not sure I trust a bystander to call 911.

Really!? I've never heard of that. I wonder if power cycling the phone would unlock it.

So, first of all, you need to correct that. It's 2023. I'm a proud luddite, but even I have a cell phone. A flip phone is dirt...DIRT cheap. Even our homeless population has cell phones.

Do all of you folks have "your lawyer" for such an event already selected?
I think most of us are in some version of a prepaid legal defense plan or similar, e.g. USSCA, CCWSafe, etc. Mine is in my phone contacts, along with my membership info. I think in this modern world, if you're going to carry for SD, a prepaid legal defense plan is an absolute must. I wouldn't do one without the other. Just consider it an operating cost like ammo and paper targets.
 
I would absolutely call law enforcement first. You want to be the one calling it in, versus someone else dropping a dime on you. ...And then find an attorney if you don't already have one. I would be concerned delaying the call until lawyer contact has been made and it in place, for a concern that it would be used against you, that you were concealing a crime. You can always say you don't want to give a statement until your lawyer is present. Our homeless population lives where there is cell service. I do not. I'm only at a location with cell service every couple weeks or so usually. To be fair, those would be the times when I'd be most likely to be involved in a shooting and I do have a flip phone. I just regularly forget to add minutes to it since it's used so seldom.

Every time I called 911 it was on a company phone.

As soon as 911 hung up with me there was a message on the phone that said that the phone was locked and would remain so until EMS released it.

If I remember right I couldn't even leave that screen.

The first time it happened I decided I was NEVER going to call 911 on my phone unless it was literally Life and Death

I'm going to a safe location, and I'm contacting my lawyer.

Then SHUT UP when the police come. Because eventually they probably will.

Well, unless you shot some street thug. In which case you may never hear from the police if you are able to SHUT UP.

It amazes me how many people don't understand SHUT UP.

Calling 911 doesn't have to be a confession. You can report that someone of a certain description has been shot and is at such and such location and that you'll standby for officers. Then call your attorney. When officers show up tell them you wish to speak to your attorney before any questions.
