Can I do a NICS in advance?

I could be wrong but I don't believe a carry permit relieves the requirement to complete a 4473, it simply means a BG check is not required. In other words, you still have to do the paperwork.

But at least twice a month I'll get a buyer telling me his CHL/LTC instructor told him he doesn't need to fill out the form.o_O
EVERY time you buy from a licensed dealer you fill out a Form 4473.

No NICS check is required if the buyer has a firearms permit from the state where the transfer takes place, which qualifies as an exemption to NICS. (not all permits qualify)

How about this scenario, which is rumored to have been done back in the days of the pre-NICS waiting period for handguns?

(1)Customer completes and signs a 4473, but no firearm information is added other than checking the box that says handgun.
(2) Dealer calls it in (or faxes, or whatever they did during that time to initiate the process) and starts the clock ticking on the waiting period.
(3) Customer leaves without buying a handgun.
(4) Customer comes into the shop three weeks later and sees a handgun he likes. Dealer pulls out the prefiled 4473 and adds the firearm info. Customer pays and takes the gun with him.
(5) Customer fills out another 4473 without gun specifics and the dealer starts the cycle all over again for when the customer comes back in a month or so.

Could the same thing be done with a NICS check? Sign the form but not add the gun info until a later date? Or am I confused and there was a separate (non-4473) form that was used to start the waiting period clock? I don't remember.

I dont know about adding guns. The form I fill out makes no mention of guns I intend to purchase and I understand they are good for 30 days. Buy on the one/week plan and get four for one check. Correct??

When a buyer completes and signs the Form 4473 it must be pursuant to an actual firearm transfer. Doing one in advance when there is no actual sale seems to violate that requirement.

What needs to be considered is the possibility that the buyer fails the background check. If there wasn't an actual purchase at the time the 4473 was signed then the dealer has some explaining to do.

No.
Before the dealer begins the NICS check he must answer Que 16 "Type of Firearm" (Handgun, Long Gun, Other).
Section D (which shows the manufacturer/model/serial#/etc) must be completed by the dealer even if the firearm is not transferred.

While the NICS transaction result is good for 30 days, its only applicable to the type of firearms identified when the check was initiated.
Additional firearms of the same type may be added only BEFORE the dealer signs and dates the 4473.

sorry for a rookie question (though i am a rookie), but just to make sure... is the 30 days down to the minute? here is my scenario...

started a background check on the 5th, but at the same time i saw a revolver i wanted to purchase next on sale so the store let me put it on layaway. i won't be back in town until about the 25th day, but if i wait until it's 29 days, 23 hours to pick up the first purchase, i could save a trip by just waiting another hour to start the next 10 day background check. should this plan work? i live in CA if that is a concern.

California uses a state point of contact and dealers do not contact the FBI directly. You need to ask a California dealer about silly California regulations.
