Current status on CCW and Beale Street Memphis TN.

Although I have never been there and have no plans to go I just learned that back in 2009 the merchants on Beale street in Memphis TN had hired security and set up checkpoints to prevent anyone from lawfully CCWing on the street there. Not in the establishments themselves but the street!

Does anyone know if this was allowed to stand? It seems to me that it would be illegal to stop and search people before allowing them to walk down a public street in most situations.

I am not a lawyer...

If ALL the property owners incorporated and formed an association akin to a homeowner association, they might be able to get away with it. As an aside, Beale is one of the areas that I think should be condemned and leveled in Memphis, but hey that's just me.

So after doing a bit of Googling, it does appear that the merchants aka association did exactly that to enforce the ban...
 
So, does that mean that Beale Street, at least the part in question, is not considered a public right of way now?

Just read that "When the streets are closed, they are private".
I'm guessing this is an area that streets are closed often, or permanently?
I'm confused how rent-a-cops have any right to confiscate guns? What do they do with them afterwards? Turn them into police? Not before I had a chance to report it stolen :)
 
I have been ther once. It is a place I would not go without CCW. Once was enough.
 
The actions of the merchants would be enough for me to take my business elsewhere not matter how tough or nice the neighborhood.
 
There is a section about 3 blocks long that are essentially closed to normal traffic. There are vendors that sell beer on the streets. So you can walk from one club to another with a beer in you're hand. Not sure about the law on TN but in AR you can't carry in a bar. That street is a bar.
 
Been there several times.
Don't think it should be levelled.
Several blocks occaisionally shut down for festivals and events.
Big open street parties with lots of fun.
Mostly younger people, but good music and eats.

Lots of drinking and partying, not a good place for guns.

From a lifetime in a no carry state and being a hard partier, I know it's possible to go unarmed and have a good time and still stay out of trouble.
Lots of trouble comes when who just don't know hpw to act push their luck.

I don't know about the crime factor there, but it seemed more fun oriented.
 
I was there last week and there were flyers posted on just about every door against carrying. I didn't read the fine print, but it looks like they are serious about it.
 
Beale street is about as awesome as a place can be. I was there about 6 years ago. Tons of free live music, lots of good people having a good time. It's essentially a large open air bar and by rights should follow the same regulations as a regular bar. Maybe if you lived there something like that would be a nuisance, but where I live you can't just walk down the street and see real live delta blues being played by real authentic bluesmen.
 
It's still a public street. The street does not belong to the merchants who's shops happen to be on it. So they have no right to close the street off to anyone.

I'd never trade my security for free entertainment.
 
All im saying is that it's a blocked off area, and it is run like a big bar and should abide by the same ruling as a bar. If TN allows carry in bars then they should allow it here, if they don't allow carry into a bar then this should be treated the same way.
