He was understanding that something was wrong with the gun after looking at the pictures, but clearly stated that all gun sales are final. When I told him he misrepresented the gun by selling it to me without disclosing the damage he stated he never took it apart so his ignorance protected him when he sold it as a working gun with "a cylinder drag line and a bit of finish wear at the end of the barrel".

That's total BS, claiming all sales are final doesn't make it so. He claimed there was nothing wrong with the gun and that was not true. I doesn't matter if he "claims" he didn't know and his ignorance does not protect him. He said there was nothing wrong with the gun, not there is nothing wrong with the gun as far as I know but I didn't check the gun either!

DO NOT tell S&W anything if you want to have any chance of them repairing your revolver. If they do charge you I would pass the cost on to the seller no matter what he claims. As we all know ignorance is not a defense.
