Do you have to go through an FFL to buy a gun?

I'm in oregon and am just curious on what the laws are as far as buying guns from private parties. Let's say my neighbor down the street has a Ruger Single Six that he wants to sell and I want to buy it. Can I just give him the cash and the gun is now legally mine with no further paperwork needed or do we have to go through an FFL to transfer the gun to my name like if you were buying a car?

I'm going to say that the safest way would be for both of you to go to an FFL holder to transfer it. I'm not one to specalualte on the exact rules for this though. I gave a 9MM to my dad and he was able to take it into the local gun shop (only ffl that he knew of at the time) and get it transferred to his name, but that was in Indiana.

Thanks....any Oregonian on here know if a prohibiting law is in place in our fine state?

There's some good deals to be had in face to face sales (not having shipping and perhaps FFL fees) but I don't want to do anything illegal

Just make sure that a bill of sale is written, in which both parties sign and date.
Under federal law, you don't even need that.

So long as you can say that you believed whomever you gave/sold the gun to was not a felon and otherwise able to legally own said firearm, that is all the federal law calls for.

Having a receipt adds more 'protection' to both parties down the road, though.

Hea Lucky Strike,
FTF sales are perfectly fine here, outside of a "gunshow." You must be legally able to own the firearm and the seller has to believe that to be true. Pay the money and take the gun. Be safe and enjoy it.
frosty 52 in "gunfriendly" Coos county OR.

From a quick look here (166.433(c)) it seems you have to do a background check if the transaction takes place at a gun show, but not otherwise. That's the same rule we have in Illinois :barf:. Also check 166.470. I'd get a receipt, just for added insurance.
