When should an LEO pull his weapon and shoot the predator? I saw the video on Fox News. The felon had his hand on the officer's neck, trying to choke him:

Escaped felon assaults officer

A squad car video camera captured violent footage of an escaped fugitive punching and beating a McKinney police officer several times on the hood of his police car before a witness helped pull the officer's attacker off of him.
Joshua Wayne Jones, 31, resisted and fought with McKinney Police Officer Rusty May Monday at an apartment complex in the 700 block of Bumpas Road after the officer stopped him while responding to an assault call in the area, McKinney Police Officer John Duscio said.
McKinney dispatch received the call around 7 p.m. Monday reporting an assault in the area by a man fitting Jones' description. Officer May stopped the man as he and another man were leaving the apartment complex in a vehicle that also matched the suspect's description.
The videotape shows May approaching the vehicle and ordering Jones to step out of the front passenger side. Jones complies, but as Officer May grabs his arm and attempts to frisk him for weapons, Jones quickly turns around and begins swinging at the officer hitting him in the face and in the temple. May tries to get him into a headlock, but Jones manages to wiggle his way out of the officer's grasp and the two struggle out of frame.
The driver of the vehicle that Jones was with begins backing away from the scene as the fight continues. Jones and Officer May walk back into the camera's frame and May tries to get a hold of him a second time when Jones slips out again and slams the officer on the hood of his own squad car punching him repeatedly as the officer tries to fight back. Jones and the officer struggle to the driver side of the squad car out of frame a second time, according to the videotape.
Duscio said Officer May was stunned by Jones' attacks and tried to get to his radio to call for backup, but he couldn't reach it because he was also trying to protect his weapon at the same time.
He also said Jones had plenty of opportunities to runaway, “but he instead chose to continue to engage on the officer.”
As the two continued to struggle, a man, later identified as Louis O'Neal Wilkins of Princeton, can be seen on the left side of the screen approaching the two men telling Jones, “Stop it, man. Don't do it.”
Wilkins, the uncle of the woman who Jones earlier assaulted, helped subdue Jones just as another officer arrived on the scene and placed Jones under arrest, Duscio said.
Wilkins said he saw the fight from about 25 feet away. He said he knew Jones had a serious temper and knew what he was capable of doing.
“When I seen him fighting the police, I jumped in because the cop didn't have a chance,” Wilkins said.
After Jones slammed Officer May on the hood of his car, Wilkins said Jones had one of his hands around Officer May's neck.
“I grabbed his hand off his throat and the officer had the rest of him in his other hand,” Wilkins said. “They got him subdued that way. I was telling him don't be doing that. He was making it harder on himself fighting the cop. All he had to do was get out and talk to the officer.”
Jones is currently wanted on an active felony warrant for escaping in 2005, Bureau Chief Bob Lauderdale of the Arapahoe County Sheriff's Office said. Duscio said he escaped while serving time a vehicle assault charge. Details of Jones' escape could not be obtained by presstime.
Duscio said Officer May was transported to Medical Center of McKinney and was treated and released. He was not seriously injured and was able to return to active duty the following day.
Lt. John Norton of the Collin County Sheriff's Office said Jones received a first degree felony charge of aggravated assault on a public servant and a $100,000 bond, and a misdemeanor charge of resisting arrest, search or transporting and a $750 bond. He remains in the Collin County Detention Center as of Wednesday.
