Fed court strikes down oppressive NJ ccw restrictions

State will appeal and doesn't mean that it will go into effect unless the circuit court approves (probably not) and then Scotus speaks (crickets for awhile). Expect a restraining order to be granted soon as was done in NYS. Note Scotus refused a TRO because Clarence was dancing around the originalist May Pole of procedural deference to the lower courts.

As in many cases, a lower court says something positive and it is negated up the chain and disappears into Scotus' time dilation machine.

I'm not a lawyer either, but If you can look up Judge Bumb's ruling you'll see what restrictions were removed by the TRO (I'm not good with the showing links stuff ). The TRO doesn't have an expiration date. Since Koons and Siegel (much wider range of restrictions) have been consolidated I'm hoping for a Preliminary Injunction since the state will most likely appeal it to the 3rd. Hoping to hear how actual attorneys versed in this type of litigation interpret all this.

Not being a lawyer, the law is enforce if the higher court stays the TRO. That's what happens and keeps the law in force for along time.

OP posted TRO for the federal case backed by SAF/FPC Koons v Reynolds (NJ sensitive places carry ban).

Yesterday, second TRO was granted for another federal case backed by NRA-ILA Siegel v Platkin (NJ sensitive places carry ban) - https://www.nraila.org/articles/202...ersey-from-enforcing-new-sensitive-place-laws

In granting the TRO, the same district court judge Renée Bumb who consolidated the Koons case with Siegel (So TRO was an expansion of TRO granted for Koons case) made a significant statement that the legislators (President of NJ state senate joined the lawsuit) consider the clear dictate of Supreme Court's Bruen ruling of Second Amendment context of historical tradition of firearms regulation and stated, "While the Legislature may disagree with Bruen, it may not disobey it."
