I hope this is the right section, it is "legal"

For FFL's that KNOW, not what some may or may not do.

When a firearm is transferred from one FFL to another (as in a gun purchase) what is the time allowed by the BATFE to record the receipt of the firearm at the receiving FFL?

I checked, and it is confusing between by the end of the next day or is it seven (7) days?

The purchase or other acquisition of a firearm shall, except as provided in paragraph (g) of this section, be recorded not later than the close of the next business day following the date of such purchase or acquisition.

And section "g" says:
g.(g) Commercial records of firearms received. When a commercial record is held by a licensed dealer or licensed collector showing the acquisition of a firearm or firearm curio or relic, and such record contains all acquisition information required by the bound record prescribed by paragraphs (e) and (f) of this section, the licensed dealer or licensed collector acquiring such firearm or curio or relic, may, for a period not exceeding 7 days following the date of such acquisition, delay making the required entry into such bound record: Provided, That the commercial record is, until such time as the required entry into the bound record is made, (1) maintained by the licensed dealer or licensed collector separate from other commercial documents maintained by such licensee, and (2) readily available for inspection on the licensed premises: Provided further, That when disposition is made of a firearm or firearm curio or relic not entered in the bound record under the provisions of this paragraph, the licensed dealer or licensed collector making such disposition shall enter all required acquisition information regarding the firearm or firearm curio or relic in the bound record at the time such transfer or disposition is made.

In short, the licensee has until close of business the next business day to record his acquisition.
Unless.........
He has a "commercial record" that shows manufacturer, model, serial# and caliber. Typically this would be an invoice or packing slip.
 
Thanks, it was the "commercial record" that was confusing me.

So when the FFL gets a shipment from a distributor like RSR or whomever,that has the firearm info, they have 7 days?
 
So, I should carry my bound book with me if I go on vacation? I have a FFL03 and one of the reasons I do is so I can buy collectables even if I am out of State or away from home.. If I'm out for several weeks and find something at a garage sale, gun show or other non-commercial location and won't be home for several weeks, what other choice do I have? I will obviously take down all the information needed to fill out my book, but would this be considered a "Commercial Record"?

What is the address on your FFL? I would think it be recorded once it arrived at your license address. In the meantime you are in "shipping mode":)

I would guess it is commercial, but heck, I worked for the Govt. You want the rules to be clear and easy?:rofl:

I don't know how it could be made any plainer than what has already been written.

Well what happens if he is on vacation for more than 7 days?:p

may, for a period not exceeding 7 days following the date of such acquisition, delay making the required entry into such bound record: Provided, That the commercial record is, until such time as the required entry into the bound record is made

He would be in violation of the regulation.

"A dealer has time requirements to record acquisitions and dispositions of firearms in his or her "bound book." If commercial records are kept containing the required information, are available for inspection, and are separate from other commercial documents, dealers have 7 days from the time of receipt or disposition to record the receipt or disposition in the "bound book." Receipts not covered by these records must be entered in the "bound book" by the close of the next business day after the acquisition or purchase. If a disposition is made before the acquisition has been entered in the "bound book," the acquisition entry must be made at the same time as the disposition entry." Google like this one.

About the same from the link in post 1. "1. Dealer Acquisitions:

If the shipping papers are kept separate, contain all info on the firearm, are available for inspection as a commercial record, you have 7 days to enter into bound book.

If firearm is sold before the 7 days , log it in , then out.

I think i get it.
