Gun Sent to ATF

Wow, this is a new one.
I hope it works out OK.

I'd bet though that you may be pleasantly surprised. The ATF folks I've talked to have always been professional and pretty helpful.
I just spoke with them about something else (actually something wrong that I may have done) this morning.
I was advised to exercise better judgement in the future but told to otherwise not worry about it.

Contrary to popular belief, they are not all out to knock your door down and stomp your family pet to death.

I'd bet that most are actually looking to try to make things a little safer.
 
I knew a guy in college who copied part of a dissertation out of the library for a term paper.

The prof had gotten married, and changed her name. She was NOT amused.

Two stories:

1) last year in my chemistry class about a dozen students got caught cheating after they all turned in identical papers. The professor didn't think it was nearly as funny as those of us who wrote our own did.

2) Two years ago a kid tried to turn in a paper cut and pasted entirely from Wikipedia. He got caught since he forgot to take out the blue hyperlinks (the paper also had neither end nor footnotes that they might be referencing).
 
Who sent your rifle to the feds?
You know you and that seller are both making it onto a list. Not the same one though.
 
The sellers error. They should bear the grief and costs of getting you your rifle or refunding your money. I would let the ATF know what happened and then let the seller make the arangements to correct it.
 
While I DEEPLY feel for you, I have to say, I am REALLY intrigued as to what all will go on, and how it turns out.VERY interesting, and likey pretty unique predicament....
The funniest (and sadly, VERY possible) thing, would be that when you call the ATF in the mornining, they laugh,say not to worry IT HAPPENS ALL THE TIME, and just foreward it on...:eek: How great in every sense would THAT be?!

where's my popcorn.....this one is iteresting.....
 
It's going to cost us millions of dollars for the ATF to change the single form document by adding a line that says "DO NOT MAIL FIREARMS TO THIS ADDRESS!"

I'd say that you had better get the idiot that you had hoped to by a gun from to immediately refund your $720, because you ain't ever going to see that gun. Better send him a self addressed stamped envelope!!!! This guy needs to be in an asylum. He's dangerous to mankind. I hope he is not capable of reproduction--course he probably wouldn't know where to "send" the package. This is absolutely rediculous and you should press it. You may have to sue, and sue for costs as well. He defrauded you by not delivering what you paid for. When firearms are involved, and especially across state lines, the rules change quite a bit--it becomes much more severe in the eyes of the feds and they become much more interested in the matter than if it were a non-firearm issue. And of course there is absolutely nothing you can do regarding dealing with the ATF, because as far as they know, you're not in the equation. The idiot that sent it isn't smart enough to deal with them, if it could even be done--that's doubtful in itself. This is so FU it's comical, but I'm sure not to you. Good luck! You're going to need it!

Asknight--that "flip" is way cool! I watched it about 20 times trying see if the blood was showing yet by the time he hit the water.

So I talked to the seller this evening and he is on board to help out and completely distressed. Evidently he handed the FFL to the gal at the UPS store and told her to send it to the FFL address. As long as this guy is answering the phone and willing to help I will give him the benefit of the doubt.

I will also be up in 5hrs to call Atlanta.:banghead:

I'm really glad you guys are having fun with this. Hopefully I will be a flag bearer to a successful campaign.

For those of you jumping on the bandwagon of flog, sue, etc... I hope you have bought and sold guns through legal channels across state lines. For every one of us that goes about this on a regular basis there are ten more asking how to do it. Until this turns really ugly (potentially in 5 hrs) I am not in that boat. Remember, this saga is less than a day old.
 
It sounds to me as though, for the sake of thoroughness, the seller needs to send them some alcohol and tobacco as well.
 
My prediction:

The black powder muzzle loader you ordered will dissapear into the ATF skunkworks for six months and will come out fully select-fire then both you and the seller will be charged with transferring an unregistered "machine gun".

I work for the Govt. in D.C.. ALL mail and packages to govt. offices go through a screening process and get zapped to kill bio threats. That usually slows delivery by a couple of days, so you might have time to contact somebody at ATF and explain the situation. I don't know about ATF but at my agency if a package does not have a PO number or is addressed to somebody by name the package is supposed to be returned unopened.
 
So another turn. I just finished a phone call with ATF. Evidently the package was denied (even though UPS tracking says delivered and signed for) and is being sent back to the sender. Now all I have to do is figure out who the sender is? The UPS store or the original Seller.

The lady in customer service said that was a new one on her when I told her the story. Stay tuned.....
 
I am in the trucking business, and I will tell you, I have seen truckloads of freight show up at Post offices and attempt to deliver to a PO box...

I am not at all surprised!

The FFLC will return the package to UPS declining delivery. It will go back to the sender.

So I have a talked to UPS and once the Package is picked up by the driver it will be back in the system as refused and being returned. Don't change the dial.

Serious uh-oh time now. It's strictly against UPS Store policy to utilize their services to ship ANY firearm or related part. I hope the UPS Store wasn't the shipper, because they're going to be dialing the ATF, local, and state police the moment they open "their" returned package and find a firearm.

To ship a long gun, you have to deliver it in person to a UPS distribution hub, FedEx hub, or Post Office.

Tell the seller to return your money. It's his problem; he shouldn't make it yours. If I screwed up when I was a contractor, I didn't tell the client to do the waiting. He should refund you and then, whenever he gets the gun back, he should ask you if you're still interested. Remember, you paid for something and he hasn't delivered the goods to you. It's a breach of contract. A mistake, but a breach nonetheless. Good luck with this. Keep us updated, ok?

When you get some distance from this experience you might be able to appreciate the humor in it. You've been plunged into a Laurel and Hardy slapstick comedy.
