What is the law on handguns and motorcycles? Is it the same as for cars or different?

If you have a handgun in your luggage on a motorcycle is that the same as having it in the trunk of your car? Does this vary greatly by state?

Mark - a subject that crops up periodically, is this!

Very much IMO state by state. I even posted a thread other day re carry on bike in OH - regarding how ''visible'' to make it!!! Answer there seemed to be - keep jacket up and over the piece so as to keep it visible.

In PA here - with CCW - simple. I just carry it as usual. But where states require keeping in glove compartment - or in view etc - well, has to be a case of bone up on that state's laws.

I have not checked but Packing.org does cover most things - or NRA site ... but this one may be harder to get all required info.
 
I plan on going on a motorcycle trip from Florida to out west. I have a FL CCW, but am wondering about what to do when I get to Oregon, Washington, California. Or generally anyplace my permit isn't valid.

Unless you have a CCW good in California, you had better have it locked up in a sadlebag AND unloaded. It would be even better to have all your ammo locked up in another locked saddlebag.

interesting issue

when I lived in FL I didn't have a permit. The gun had to be in some kind of holster or bag and the (gym)bag had to be on the bike not slung over my shoulder,the cop on the phone said it has to be "two steps" to get the gun and if I had it in my gym bag over my shoulder it was a felony,I asked him how do I transport from my bike to the indor shooting range I was planning to go to he said "all I can tell you is if you did that you would be committing a felony"
I strapped the bag on the bike and crossed my fingers into the range.
I've carried lots of pistols while biking,often speeding and lane splitting never got searched once...btw I don't have a bike right now but I can tell you some good roads to ride on...oh yeah -lane splitting is legal here in CA
 
I'd rather carry a rifle or shotgun on a bike. Seems like it would be more useful. And with CCW almost everywhere pistol problems are all but answered.

So how about it? What about rifle or shotgun? Personally I would like to build a trunk, that is camouflaged to look like a tailpipe or something. That way some perp is much less likely to jack your gun, since he doesn't even know what the trunk looks like. What are the legal issues of doing this? :whistling:

not just better, required! in CA your ammo and gun have to be in seperate locked containers.\

ammo may be able to be unloakced, but definitely gun has to be , and seperate.

a full mag , or even ammo in same bag qualifies gun as "loaded" here
 
As I understand it, lane spliting is not illegal in California - which is almost the same as legal. Texas has a bill in process to actually make it legal here. 79(R) HB 1522

Regardless of its passage, I don't think I would ever want to do such a thing - too many idiots here. Had a soccer mom try to kill me yesterday just pulling out of a side street. Fortunatly, I anticipated her stupidity. :cuss:
I haven't gotten skilled enough on my bike yet to want to carry on it. I have more fear of landing on my gun in a crash than being jacked. :eek:
 
California gun laws are a pain to decode....all 65 pages of them. (And more every year.) I even have a book by the title of "How to own a gun and stay out of jail in California." :banghead: The laws for handguns are a lot stricter than for long guns. As for handguns, when in the car or on the street, (outside of a "rural area") they have to be unloaded and in a locked case. And a loaded mag cannot be in the same case. As for long guns, well they have to be unloaded. Technically you could strap an unloaded long gun accross your back while on a cycle and be legal. (As long as you stayed out of a school zone.) But I don't think you would get very far. BTW, to be legal with a long gun in a school zone, it has to be unloaded and in a locked container. I would imagine a soft rifle case with one of those tiny locks on the zipper would be fine. Manoman, I have read and re-read these damm California gun laws many times. My last go around was a debate I had with my brother-in-law. Come to find out that according to the law, in a RURAL AREA (like deep in the National Forest of something) it is legal to have a rifle in the car or truck with you with the chamber empty and the magazine loaded. There is also a multitude of exemptions for travling to and from a gun range, or hunting/fishing or camping.

That is a completely different lane splitting than what they have in Cali. That bill will only allow us to legally move through traffic during times of congestion, in other words, go to the front of a long light or an accident. In Cali, they can lane split anytime based on what I read in an issue of Motorcyclist.

Also, don't fret losing your piece on your bike. Get yourself a quality holster and it will stay with you when you come off. Don't ask me how I know, but I know. :) If you come off in a major way, weapon retention will be the last of your worries.

Since I have a CHL, I don't worry about carrying a pistol anymore on the way to the range. However, before I had one, I talked to a few HPD guys and tried to find out if it was legal to have them it in my backpack. While nobody would commit to answering the question all of them seemed to indicate that since the backpack was inaccessible during operation of the vehicle that it could be construed as being similiar to the trunk of a vehicle. However, once you get off, it is accessible and could be considered on or about your person. I don't think there are any AG rulings on that though.

As for rifles, they are legal to have in a vehicle in Texas. I've ridden with the AR on my back and haven't been stopped for it. I'm sure your state laws vary and maybe you could get a lawyer friend to hit your AG for a ruling?
 
I use my tank bag for ammo even when I cage it to the range. I keep the pistols, (Only 2 right now,) in a locked case in my back pack. That keeps me Cali legal, and it is conveniant as well. It's a bitch to get the targets home, though.

If I want to fire the long guns, then I take the car or the Jeep.
