Form 4473 is required regardless, and is not a 'NICS' form, it's an ATF form.
What was being bypassed for CPL holders was the NICS check itself.
This 'bypass' is being rescinded by the ATF for States that have Legalized Marijuana Recreational use unless that State in question has made rules to investigate and revoke CPLs for persons who choose to use marijuana. Until Michigan legalized the recreational use of marijuana, presenting my CPL during a purchase negated the NICS check. Now the FFLs don't care if I have a CPL at all, the NICS check is required regardless.
Since Federal Law prohibits the use of marijuana, users of same who select 'no' for question 21F can potentially be charged with a felony. Users who select 'Yes' automatically fail the right to purchase a firearm legally. Note: although 21F specifically asks if you "are an unlawful user", and people may think that if they are in a State where it is legal to use the drug they can answer 'No', the form has a warning to the effect that under Federal Law marijuana is illegal to use or possess regardless of State Laws.
