COWARTS, Ala. (AP) - Houston County authorities say a homeowner shot and killed one of two men accused of breaking into his rural
home near the Cowarts community Saturday night.

A second suspect was caught by officers called to the scene. The shooting reportedly took place in the living room of a residence on U.S. 82 East.

Houston County Sheriff Andy Hughes says the homeowner, Peter Webb, dialed 911 at 7:41 p.m. reporting two men had broken into his house. Webb ordered the two men to the floor. The sheriff says Webb fired his handgun when one of the men charged at him.

The dead suspect was identified as 20-year-old Colie Laquad Dunlap of Dothan. Authorities said his older brother, 23-year-old Christopher Lee Dunlap, was charged with first-degree burglary and is being held in the Houston County Jail under a $200,000 bond

Hughes said the homeowner will NOT be charged because the shooting appeared to be a case of justifiable homicide. He said the case will be presented to a grand jury for review.

I'm sure there was always tension between the brothers, one being colie laquad and the other was..... christopher lee. I wonder who envied the other more, though.


It could've gone better had both of them just laid on the ground when ordered, been arrested unharmed, gone to trial and to jail, served their sentences and turned their lives around... but in the real world I guess we have to compromise.
 
And why isn't this a FOX NEWS ALERT?

Or breaking news on MSNBC?

Why aren't we getting in depth analysis about the psyche of the criminals - or human interest side of the homeowner?

Why isn't this on a CNN ticker?

And what kind of weapon did the homeowner use?
How many bullets?
Was there one in the chamber prior to the criminals entering the home?
All those things were covered in the story about the Disney gun tottin' granny - but why not now?
 
These people are slipping, the kids mother should have stepped in by now and said her son was a good boy and would never hurt anyone and the naacp/aclu should be screaming excessive force. There was another case this week about a white woman who was beaten by 9 black teens and the kids mothers accused the woman of provoking them, go figure:cuss::barf:
 
It was a handgun, in a follow up story, one shot to the pelvic area, he got about 100 yards before collapsing.

A 24-year-old Dothan man has confessed to a burglary Saturday night which ended in his brother’s death.


On Monday, Houston County Sheriff Andy Hughes said 24-year-old Christopher Lee Dunlap admitted to investigators he burglarized Peter T. Webb’s Highway 84 home on Saturday with the help of his 20-year-old brother, Colie Laquad Dunlap. Hughes said an undisclosed amount of cash was stolen during the burglary. Before the two brothers could escape Webb’s home he confronted the men and fired a .38-caliber handgun at Colie Dunlap one time, killing him.


Christopher Lee Dunlap was arrested shortly after the burglary Saturday around 7:30 p.m. He is held in the Houston County Jail on a $200,000 bond after he was charged with felony first-degree burglary.


“It’s our belief they didn’t know each other,” Hughes said said of Webb and the Dunlaps.


Hughes said their ongoing investigation has shown the two brothers were likely not armed during the burglary. Hughes declined to reveal other details of Dunlap’s confession until the completion of his trial.


Sheriff’s Capt. Antonio Gonzalez said the burglary appeared random, that the two brothers had not specifically targeted Webb’s home.


Gonzalez said the investigation has shown the men entered the home by forcing their way through a back side door of the home. Webb encountered the two brothers after he went to the back of his home to investigate a crash he heard inside his home.


Webb apparently told the men to get on the floor and as he attempted to call 911, Colie Dunlap started to get up off the floor, Hughes said.


“The deceased kept crawling toward him,” Hughes said. “He all of a sudden jumped up from a prone position. Mr. Webb felt threatened, the suspect was larger than he was, there were two of them and he was afraid for his life.”


The brothers ran from the home, and when Christopher Dunlap could not get his younger brother to get in their vehicle he left without him. Hughes said Christopher Dunlap left Webb’s home in a white Cadillac, picked up his mother, Louise Bostick, and brought her back to her son’s body.


Hughes said deputies have seized the Cadillac as part of the investigation. Deputies also found at least one ski mask and gloves at the home.


Webb’s elderly mother was in the home, but she was in bed at the time of the burglary, Hughes said.


“He only fired one shot, and to the home owner’s credit at that point he perceived the threat was eliminated and he used restraint to not fire any other shots,” Hughes said. “We’re investigating why they possibly chose this house to burglarize, and we want to see if they can be tied any other crimes.”


Webb could not be reached for comment on Monday.

Authorities will likely not seek charges against Peter Webb, who shot and killed a burglar Saturday night at his Dothan home, according to Houston County District Attorney Doug Valeska.


Valeska said preliminary reports from Houston County Sheriff Andy Hughes and his investigators have shown him no need to seek charges in the shooting death of 20-year-old Colie Laquad Dunlap.


“I see no prosecution of the homeowner,” Valeska said. “People don’t need to go out and burglarize homes in Houston County. We won’t have any deaths and victims won’t be traumatized that way.”


Valeska said he has prosecuted multiple capital murder cases that involved burglaries, including David Wilson who was recently convicted of killing 64-year-old Dewey Walker during a burglary at his Dothan home. He said the death likely could have been prevented had there not been a burglary.


Sheriff’s investigators have said Dunlap and his older brother, Christopher Lee Dunlap, 24, forced their way into Webb’s home and stole cash from him. Christopher Dunlap is held in the Houston County Jail on a $200,000 bond after he was charged with first-degree burglary.


Webb was defending his home when he chose to shoot Dunlap, Valeska said. Valeska urged residents to call law enforcement if they see any suspicious activity in their neighborhoods.


“This time of year at Christmas time if someone is going to break-in and steal someone’s hard-earned dollars and steal their Christmas presents they need to realize the price they can pay. They could forfeit their life too,” Valeska said. “Based on what the sheriff and the investigators have told me it’s my opinion he had a right to use deadly physical force.”


Alabama Attorney General Troy King said a relatively new state law allows for residents in their homes to protect themselves with reasonable force. King said the “Castle Law” has legally allowed residents to stand up for themselves.


“A man’s home is his castle,” King said. “No Alabamian should be expected to turn around and run away from a person who is threatening them or their family.”


The law, passed in June 2006, has made Alabama safer, allowing them to use deadly force to protect themselves, he said.


“One of the problems we have in this country is that we coddle criminals. All the concern is about criminals,” King said. “I grew up in the Wiregrass and I know a little about common sense. Common sense says I should have at least the same right to protect my family that a criminal has to threaten them.”


Sounds like a win for the "Castle Doctorine" laws and the homeowner. Looks like this will work out fine.

Sad to say, most criminals are not smart enough even to learn from their own mistakes, still less others'.
