i have been hunting deer with my 590 with a plug in the tube mag so i can only hold 5 rounds i just read a post that says no firearms that have been altered in magazine????????? worded so dumb cave man like me cant understand of course i also use a ak with a 10 round magazine that i installed a couple screws in the mag so i can only hold 5 rounds is this all illegal or am i reading something wrong??? i was under the impression this was the correct way to go about this talked to a fellow who used a fal for deer, hard to come by 5 round mags for a fal of course said he does the same. i thought thats why you use duck plugs in the tube mag of a shotgun maybe i'm just tired and reading something wierd or maybe ny state cant write laws that make sense to common people or maybe i am dumb:( prolly the latter any info would be great

I would call someone, nothing beats picking up the phone...unless you end up talking to someone useless!
Find the right authority to talk to....if you can get their name. Better yet email them so you have proof of what they say

A.) Call the state DNR or whatever its called in NY.

B.) With my limited knowledge of NY State law im going to assume that
no firearms that have been altered in magazine
is intended to be a redundancy in the law with reference to the No Detachable Magazines law. As such I can also tell you that if you are using a waterfowl plug in a shotgun then you have not in fact "altered the magazine" and have simply blocked it. As far as rifle magazines are concerned I am not familiar with the blocking methods used, perhaps inserting some training rounds would suffice instead of just screws which may damage the magazine.

Also in the future please specify the type of gun you are referring to, I only know what a 590 is because I own a Mossberg 500 and therefore am familiar with the product line.
 
plugs in a shotgun are legal in new york, magazines have to have their capacity secured in a permanent way ie: a rivet or a spacer permently secured with no immediate means of removing it. screws do not count.
 
Thank you cdet69 i'm gonna rivet my 10 rounders i use for hunting. i appreciate it! that was the info i was looking for

now i feel i must say im not a lawyer ,dec, law enforcement officer.for mag reduction , pull of the bottom plate and just block the area off untill you get a 5 round capacity, no need to ruin good mags. if checked by a dec ranger for capacity , they will push on your loaded mag to see if there is room for more cartridges ,then they may unload it to count the rounds, a pain if your hunting but not really a big deal. the shotgun plug is also fine, though for waterfowl you can only have a 2 round magazine capacity.
the laws are written to be confusing.
i myself hunt with a saiga .308 and use 4 or 5 brasscases to limit capacity,i got this info from dicks music oasis and gun emporium four years ago. i also hunt a saiga .223 with plugged mags, an ar-15 .a mossburgh 590(rangers just hate the bayonet lug and my collapsable stock) most upstate troopers THINK they know what the laws are and enforce them whenever convenient and its usualy not even a real law, in example i got into a 3 hour debate about how i CAN be within 500 feet of a ROAD ,as the law says you cannot shoot from the maintained highway(the road and area around it that is taken care of by the state)so they decided to take my rifle to "check its legality"
mind you this is the last day of rabbit season, in a dec hunting area. when they couldnt write me up, they tried to provoke me with humiliation,yelling, bulling and general nastyness. watch out for these cops, they are your worst enemy up here.

upstatenyhunter thanks also more good info! its too bad few of the dec are looking to bust heads all the time, same with ordinary police. it only takes a couple to give the whole bunch of'em a bad rep. the worst is when police/dec goes the route of trying to goat you into an argument that they would like to make into a fight or disorderly conduct arrest.
