Hey guys, I appreciate all the comments, concerns, and suggestions.

I am going to meet the PO in the morning and talk to him about it. Barring any major changes, I am going to hold the guns till next week when I go home to MD. I will drive like my grandma and leave them where I want, which is at my mothers house.

After that is done, I will attempt to have a provision or something made by the orginal federal judge via my lawyer.

fyi- I have not been given a specific time frame to get rid of the firearms, so in this instance, I will not be so liberal about the exact location, condition, etc of my guns.

I know there's ways to get around it, but many storage places, especially the large chain type places, won't allow firearms or explosives (ammo). Sucks if there's a fire or a break in because they can't claim it against their insurance because the person will have signed a contract stating they won't store prohibited items. Handguns would be easy to smuggle in, but these places have extensive video coverage. Long guns and/or rifle cases would be pretty obvious.
 
The storage unit was mentioned in post #5 and #9. Are you not reading our advice? :D

I dont trust anyone around here, including a storage facility....

i.e. never entertained the thought of using said facility

That's sure not what you said. There's a difference between "entertaining" an idea and never having it even cross your mind. Just razzin' ya. :)
 
sigh, im 22, im 4 hrs away at college, my parents dont have the freedom to just pick up and leave for an 8 hr. trip...not to mention I dont want to hassle them. I'l take them home myself in a week
 
If I were you cdcmj, right or wrong, I would have checked "No" when they asked about firearms on the form and IMMEDIATELY driven them home in MD the first chance I got. Like that SAME day, even if I had to drive all night and/or miss classes. They're not going to home visit you that quickly. Heck, I'd even go so far as to spend a day/night in a motel so if they did visit, I wouldn't be "home". From that point on I could honestly say I wasn't in possession of any firearms. One thing I learned in the military was sometimes it's better ask for forgiveness than permission...or don't even ask at all. ;)

Simply put, I had to sign, and thus engage myself to the rules set forth by the probation office. The second rule was with regard to firearms and the fact that I wasnt allowed to possess any. I signed as there was no option not too, and then I advised the PO that I indeed owned legal firearms, and what was I supposed to do. He then initially told me it wasnt going to be a problem....but a day later it all changed.
 
I still would have checked "No" because, technically, at that EXACT time you were not in possession of your firearms. Possession and ownership are NOT the same. Then you could have made an immediate bee line to your parents' house that very day. But, it's all water under the bridge now...

Read what cdcmj said, there was not a "No" box to check. This is pretty standard.

Typically, a probation form lists the conduct expected of the person on probation and the person then signs acknowledging understanding and receipt of the rules. You don't have to sign as jail is an available option.
 
Most of the storage areas around here offer a first month free or nearly free deal. No long term lease either. Would be a nice short term solution. Pay cash.

I am curious about the ticket. In Missouri if I got that ticket a lawyer would plea it down to something less and it would cost me some extra money.
 
Hanno, yes, you are right. I misread the "yes or no" thing. All he had to do was sign and rule #2 was no possession of firearms, which was technically true at the time of signing. Personally, I would have taken my chances and moved them that very day to the folks in MD. No way for them to prove he ever had them in his direct possession after that. Other than allowing the police to come to cdcmj's place and confiscate them, he'd have to move them via car somehow since he said having his parents drive up wasn't an option, so the best bet would have been to take them to the safest place (family). Just don't get pulled over! :eek:

I wonder what my chances are for the judge making a provision. I imagine that providing a documented police report of a larceny and breaking/entering would help too. Any comments?
 
It might help, but I'd still get rid of the firearms NOW! I know you're waiting, but the inconvenience and gas money of driving through the night is a better alternative than having your weapons confiscated and you possibly getting into even more trouble and losing your RKBA for good. You live in an apartment, right? If your area is "safe" enough, why not put them in your car/trunk? Even if you have a surprise home visit, they're not going to search your car. Better than nothing for the short term.

edited to add: Be very careful about divulging break-ins and larceny to a judge ESPECIALLY when it comes to you owning firearms at the same premesis. Do you have a good safe? You could bring a world of hurt on yourself admitting to being broken into more than once and having unsecured firearms. You mentioned something about having readily visible firearms. That won't look good...

I got hit for 90 in a 65 and I paid my fine took my 9 points, I did the paper work for my restricted lic. bang good to go.

feel lucky I have to pay the illegal fine they tack on. $1100 dollers. total cost of my speeding ticket was a nice cooper rifle.
 
My PO, who is essentially my life line of my fate of being in trouble or not is intimatley aware of this gun situation. He even said, "we'l talk about this issue tommorow," when he comes by in the AM. My Shotgun is mounted to the mall 24/7 under lock and key. My pistol is in a holster locked and loaded whenever I AM at home. Other times, it is cable locked and put in its case, once again under lock and key.
 
cpp: i had the same situation, but just had probation tacked on--hence the issue.

Could be due to it being the federal U.S. district court of E. VA, not state, not county, not city.

God speed, God bless...and be prepared for the fact you might face some armed response/backup since he "knows" your gun situation. I really hope this doesn't come to pass, but I can see a confiscation for you tomorrow in the "AM".
