Interested in a SBR rifle

I am interested in doing a SBR AR15.

Can I just simply buy a Pistol AR upper and put it on a Rifle lower assuming I have all the proper stamps.

Or do I need to take a current Rifle upper and switch out the barrel?
 
You will register the LOWER as the Short-Barreled Rifle. It will need to have the appropriate engraving done, along with all applicable paperwork.

Then you can put whatever upper you want on it.
 
You cannot attach a short upper to a receiver that has once been a rifle until you properly register the lower as Sam1911 says.
What many folks do is start with a short upper & pistol lower or a virgin stripped lower and use the gun as a pistol while they wait for the 7 months to get approval. When approved, you slide the stock onto the tube and you have your SBR.

That is was I did, but I used a pistol buffer tube to be safe instead of tube that could accept a stock, since I have multiple ARs and several spare stocks I've swapped in and out over the years.
 
Yep... Here is the letter I found on AR15.com regarding the use of a standard buffer tube on a pistol.
The letter states that both types of tubes are allowed then goes on to say that possessing a stock that can be readily attached could constitute possession of a SBR.
My AR15 pistol is in my bedroom and the stock is in a box of spare parts in the basement so it can't be readily be attached :uhoh:.
Plus, the ATF has my form 1 already (shows intent to follow the law) so I am comfortable with a standard tube.

Thanks. I know I cant legally attach both assemblies until I have the tax stamp.

I bought the lower and plan on getting it serialized and the paperwork started soon.

I'll then buy the upper and put the two parts seperate in the safe until the paperwork comes through.
 
If you bought a lower, it's already serialized. You do not change or add a serial number. You use the current one. The engraving would be your name, or the name of your trust, LLC, etc, along with city and state
