May 23, 2008 -- Mayor Bloomberg won't be able to say his piece about the gun menace on the city's streets at the upcoming trial of a Georgia gun dealer, a judge ruled yesterday.

"I'm not going to permit the case to turn into a media show for either side," said Brooklyn federal judge Jack Weinstein. "I see no reason to have the mayor here."

Bloomberg had hoped to take the stand next month against Jay Wallace, owner of Adventure Outdoors, which allegedly illegally sold guns later used by thugs in New York.

Bloomberg sued 27 out-of-state gun dealers in 2006 for illegally or negligently selling guns that made their way here.

All but three have settled, agreeing to let a special master oversee gun sales in their shops. Two others are slated to go to trial in September.

Actually, given the judge's history of being the NYC judicial pipeline for the antigun legal actions, any ruling by him should be construed as a victory for the anti-gun crowd.

He's also prohibited the defense from even mentioning the Second Amendment. All those dreary old former rights are so boring, I guess.
 
So do we know who the three dealers are who chose not to settle? If they're in Virginia I'd like to send some business their way!

So let me get this straight, they agreed to allow some New York wiseguy hang out in their store, in their state.. and tell them who they can sell firearms to? ***?

Worked with him before we both retired-one of the nicest guys you'll meet-'course he spends a lot of time away from the shop, volunteering a LOT of time with the local rescue squad (sounds like Bloomberg's idea of a bum, eh?).

I've bought darn near every gun I have from him, as he pretty much has a "no haggle" policy, but I rarely/never seem to beat his prices-he just hangs a low price on 'em (compared to a LOT of places I've visited) so no haggling's really required!

You'll probably be doing yourself a favor by giving him your business, although I'm sure he'll appreciate it!

Not to say I don't believe you, but could you please provide some proof that these fine gentleman, whom you so eagerly advertise, are actually one of the three dealers that refused to settle in the case?

As a previous poster said...Google "Old Dominion Bloomberg" and you'll find plenty of stories 'bout Old Dominion being one of the stores that's fighting it-'course that's not proof that he hasn't settled since the story was written, is it?

AFA "eagerly advertising" for 'em...I have nothing to gain from doing so, except helping keep my favorite gun shop in business-I stand to gain nothing more than that.

Fer a little "behind the scenes" reporting, from an earlier post I made here:
A couple of goodies involving one shop owner who is fighting this thing:
1. Bloomberg’s cronies ARE on a fishing expedition, as they’ve requested info on specific guns (by serial #) that supposedly were involved in “something” in NY.
Guess where these guns are? Yup…the original owner of the gun brought it to the shop to prove he STILL had the gun-ain’t ever been outta his possession, and ain’t ever been anywhere near NY!
2. Shop owner has received a settlement from one lawyer/firm involved in this case for “Conflict of Interest”! The shop owner became suspicious with some of the things happening legally, and did some investigative work of his own. His lawyer found another lawyer on the case was guilty of conflict of interest and either said lawyer or his firm offered a settlement to the shop owner. The shop owner took the money and is using it to defray some of the costs of fighting Bloomberg.

Also from what I understand...
The shop owner is also being sued by his insurance company!
He was told/was under the impression his insurance would not help cover any of his legal bills. The lawyer he has in New York (handling things on that end) told him to send him a copy of his insurance policy, and upon review his NY lawyer told him his insurance company IS liable for some of his costs. Things get a little fuzzy here (I just pick this stuff up when I'm browsing the store)...but I think his NY lawyer was talking about suing the shop owner's insurance company, whereupon they fired a pre-emptive strike and sued the shop owner (for what I can't tell ya)!

I don't see how he can do this.

I would think a judge would realize that the Constitution is LAW.

You cannot have a trial and say that a particular LAW cannot be mentioned.

If the judge deems a particular law irrelevant to the case, he can suppress mention thereof.

In this case, nobody is contending that the dealer does not have a right to keep & bear arms, or even to sell them; the case is about whether "interstate commerce" regulations have been violated.

We're outraged that the judge won't let the dealer mention the 2nd Amendment ... but we don't know WHY the dealer wants to mention the 2nd Amendment.
 
This paticular judge is as anti-gun as they come. But he is smart enough to know that if Bloomberg is put on the witness stand and under outh he can be forced to submit to direct and cross examination by the respondent's attorneys. If that happens His Honor the Mayor could be in deep, as setting up a straw buy without the ATF&E's express permission (which he didn't have) across state lines is a crime

The judge would prefer that this didn't happen.

Bloomberg drops one!

Found out today that Old Dominion Guns & Tackle in VA has been dropped (by Bloomberg) from the lawsuit.
Don't know the particulars, but as I understand it, the lawyer in NY handling the gun shop's legal issues on that end "found" something, and as a result Bloomberg and his cronies have dropped them from the suit.

The suit against the other shops continues...
