Knife Legal Question - California

I think not. California's knife control laws seem to address switch blade knives, and dirks and daggers. Knives that are sinister in their ability to be quickly drawn and used for unlawful purposes. A fixed blade knife hidden in a credit card like case that you have to dig into and remove to put into action doesn't seem to fit that criteria. However, there is always the law enforcement officer and district attorney who is willing to stretch the definition and intent of the law to fit his or her purpose who might create problems for you.

The best bet is for you to lead a lifestyle that does not attract the attention of law enforcement officers.

The Toologic critter in question isn't really addressed in my site. It's just one of those oddballs :).

OK, the deal is, it might *technically* be illegal but in reality, you'd have to be dealing with a cop why REALLY wants to pop you (read: what ELSE are you up to?) and the DA would probably laugh it off.

One possible legal defense if it got that far: while holding it how you'd normally hold it (forefinger in that cutout?), measure how deep the blade could concievably stab.

Here's why: we know from Penal Code 653k that switchblades with a blade length under 2" by at least a fraction is LEGAL for street carry, concealed or open (your choice). I can't tell from the pic, but it seems likely the cutting edge is 2" or less?

Basically, we can make a good case that fixed-blades shorter than 2" aren't an issue because according to 653k, even "evil switchblades" completely banned for street carry (versus fixed blades that are legal in open carry) aren't an issue if they're short enough.

Now, if you ever have to actually defend yourself with it, God only knows how it'd go. But if you're relying on this for *defense* you're an idiot :D - the proper role for this is a utiilty knife that won't scare sheeple, so you don't have to pull out your Cold Steel Vaquero Grande (pictured above!) to cut open boxes at the office or finish cutting up pizza at a restaraunt.

(My daily carry is a 5.5" megafolder, while my "sheeple friendly" piece is a Swisstech Utilikey or multi-tool. I strongly recommend this policy and the Toollogic is a fine variant of small utility knife.)
 
I dunno, looks like an evil push dagger to me. :rolleyes: Don't take it on a plane, it could be modified to work like a tactical box cutter.

I was not really considering this as a self defense issue. Were that to come to pass there would be twenty or so pieces of 10mm brass, my Emerson Commander and my Leatherman wave broken on the ground first.

I was really approaching this on technical grounds. You figuring they are selling these things all over when in fact they may be an item, which if used as intended, would be illegal.

I some times use the vaquero grande to open boxes and cut string. heheheheh! great fun,everyone thinks that the swat team will come out to get me,and insist that I am breaking the law.Of course they can't prove it...
