Legalities of reselling Tannerite

I have some extra cases of tannerite that I won't be using. Does anybody know if it's legal for me to do a FTF sale here in Texas to get rid of a couple of cases?
 
If you've already mixed it, no. You cannot sell it or even legally transport it. If it's just the components, yes. That's why Tannerite is legal to sell in the first place: it's not considered an explosive until mixed, and the components are unregulated. If it was legal to buy the components in Texas in the first place, it's legal to sell the components.

WHY IS TANNERITE™ LEGAL? Answer: Manufacturing is a commerce issue governed by the feds. Page 58 CFR 5400.7 General Q&A Section, new edition: #36. When is a Federal manufacturing license required? "A manufacturer's license is needed ONLY by persons engaged in the business of manufacturing explosives materials for SALE, DISTRIBUTION, or for BUSINESS use. For example, persons engaged in the business of providing a blasting service using explosives of their own manufacture would be required to have a license. Persons who manufacture explosives for their personal, NON-commercial use would not need a license."

And:

The CPSC (Consumer Product Safety Commission) had taken it upon themselves to try and stop the sales of raw chemicals that could be used for the manufacture of firecrackers. Tannerite Exploding Target company does not sell raw chemicals to build firecrackers. In an effort to work in concert with federal agencies, Tannerite agreed to not sell raw, pyro-related chemicals that are commonly used to build firecrackers (even though there is no particular law against that type of business). In fact, Tannerite is still a legal product, and is specifically exempted by CPSC agency in writing.

As sold, it is NOT an explosive. Therefore, they are not manufacturing explosives for sale, distribution, or business use. The components themselves are unregulated. Therefore, no special license is required for the sale of Tannerite components.

However, in some states, mixing Tannerite may fall under laws barring the manufacture of illegal fireworks. Know the laws in your state, and don't be stupid.

Point noted. OTOH, I have two full cases that I can still play with and unfortunately little time to do so.

I'll be selling them FTF in Houston sometime in April when I have time to meet with somebody. I'm thinking $160 for both cases or $85 for one case, which is a bit under what they sell for ($89 per case or $160 for two) minus the shipping ($15). I figure that's fair.
 
In September a year or two ago Texas passed legislation that makes AN illegal to sell, buy or possess with the intent of making an explosive device.

I'm not sure if an interactive target meets the requirements for an explosive device but I, for one, would not want to argue it in court.
 
The point about the legality of Tannerite is supposed to be (a) that the seperate components have be mixed before it will explode and (b) that the only practical way to make it go boom! is to hit it with a high velocity bullet. Fire wont make it explode. Blasting caps as used for dynamite wont make it explode. And the "cannon fuse" used for homemade fireworks wont make it explode. The only "practical" use for Tannerite is as a reactive rifle target.
 
Hmmm. I was not aware that a blasting cap or other initiating device would not set one of those off. Not that it really matters. Since blasting caps are regulated and Tannerite is not.
