Linn County Sheriff Sends letter to Biden - No intent to enforce

Please folks try and remember the last 4 + weeks have been some of the most trying and disturbing times I can remember in years. I read and heard normal and sane people say some of the most outlandish things.


If there is one time we have to take the “high road” and present ourselves as calm cool sane and rational adults this is it.

Exactly.... If anyone bothered to watch the NY proceedings yesterday, it was clearly evident they didnt care about facts, figures or a single darn thing other than getting their half baked law, passed and beating Congress to the punch.

thanks for clarifying. The Sheriff was on national news this morning. just goes to show that NOT everyone in public service is screwed up.
 
I admire the sheriff's initiative, but it will change when all federal funding in his county dries up.

that would be another win for the constitution. the federal govt has state and local govts by the balls due to federal funding. this isn't how it's supposed to work.
 
My patience, too, is wearing thin. It's harder to maintain a "nice face", and it's showing.
 
Just recieved a text alert from OFF. Looks like several other Oregon sherifs have stepped forward with letters to Vice Presiden Biden concerning their stance on the administrations efforts.

OBAMA ANNOUNCES GUN BAN.MORE SHERIFFS SAY “NO."


Today Obama announced his proposals to punish law abiding gun owners in America, partly by bypassing Congress with executive orders and also with a push for a new ban on firearms and magazines. This is the man who starts every speech with “no one wants to take your guns.”

His proposals include an end to private sales and greater Federal intrusions into mental health records.

As you no doubt know, Sheriff Tim Mueller of Linn County has written a letter to Joe Biden saying he would not enforce unconstitutional gun laws. According to KGW news, Crook County Sheriff Jim Hensley said Tuesday he sent the same letter to the Vice President.

Now Sheriff Glenn Palmer of Grant County has joined them. Things are going to get a lot more interesting.

On a similar note, I talked to my Sheriff. He has received LOTS of emails and phone calls from people who are extremely upset over what Obummer is trying to do, and they won't put up with anyone trying to take their guns away.

The Sheriff said he takes orders from no one--except his wife. :evil:
 
It appears Sheriff Jim Hensley has stated the same.

PRINEVILLE, Ore. (AP) -- Another Oregon sheriff says he would refuse to enforce any new federal gun law he believes is unconstitutional.

Crook County Sheriff Jim Hensley said Tuesday he sent the same letter to Vice President Joe Biden that was sent Monday by Linn County Sheriff Tim Mueller.

The letter says politicians are attempting to exploit the deaths of innocent victims in the Connecticut school shooting by supporting laws that would harm law-abiding Americans.

Hensley told KTVZ he believes in the Second Amendment, and he says officials should consider other factors that may have a role in mass shootings, such as violent video games.
 
I applaud sheriff Mueller’s brave stance, regarding his decision to have his deputies enforce or not enforce any pending legislation. I do have two problems with his decision; Sheriff Mueller took an oath to uphold the law, not just the laws he approves of. Second sheriff Mueller may be in for quite an unpleasant surprise if he actively attempts to stop or obstruct any Federal law enforcement officer who is acting under color of law.....

If he took an oath to defend the Constitution, then his opinion of a law can have a bearing, and be based on that. The Constitution should have preference over any particular law. If any law is in direct conflict with the constitution, any law enforcement officer (at any level) should refuse to enforce it. That can start to sound like the issue with the German soldiers in WWII, "I was just following orders". Not good enough.

What if the Sheriff was called upon to enforce a law such as Harry Belafonte suggested, to "act like a 3rd world dictator and arrest and throw in jail anyone that criticises the Pres, so he can get on with his good work" without interferance? Would such a law (assuming it was a law) be open to refusal to enforce because it was patently unconstitutional? I believe it would be.

Dear Mr. President,

My name is Charles M. Heiss and I am the Sheriff of Johnson County, Missouri. I have held this office since January 1, 1997. I am writing to you to express my concern with the tone of your administration with respect to the Second Amendment Rights of American citizens. It appears to me and many Americans that there is a genuine desire on the part of your administration to restrict the Second Amendment rights of law abiding American citizens in the interest of curbing gun violence in our nation.

Throughout our nations history the United States Constitution and the Bill of Rights has served as the very foundation of our free society. The Second Amendment to the United States Constitution has long guaranteed our citizens the right to keep and bear arms and is central to our ability to live in a free society. Any attempt to restrict these Second Amendment rights through executive order is unconstitutional and tantamount to an all out assault on the United States Constitution. Just as the Fourth Amendment to the constitution guarantees our citizens the right to be secure in their persons, houses, papers, and effects against unreasonable search and seizure, the Second Amendment guarantees each of us the right to keep and bear arms to protect ourselves from anyone who would seek to cause us harm. This includes the federal Government.
World history has shown us that when a society does not possess the ability to defend itself it becomes ripe for victimization by criminals, and ripe for government oppression. One need not look too far in today’s world to see glaring examples of defenseless people being brutalized by rogue regimes and dictators. Syria, North Korea, and Mali are just a few examples of this type of oppression. Mexico is a stark reminder of a society overrun with criminal element in the form of Drug Cartels.

As the duly elected Sheriff of Johnson County, Missouri, it is my sworn duty to protect and defend the Constitutions of the United States of America, and the State of Missouri against all enemies both foreign and domestic. This means I not only have the duty to protect my constituents from incidents of crime, but I also have a duty and responsibility to protect and preserve the individual rights and liberties afforded and guaranteed to every citizen by our constitutions. This, Mr. President is a duty I fully understand, appreciate, and will carry out with great vigor and conviction. I will most certainly urge my fellow Sheriffs in the State of Missouri and across this great nation to rise to the defense and aid of all Americans should the federal government attempt to enact any legislation, or executive order that impedes, erodes, or otherwise diminishes their constitutional right to keep and bear arms. I will use all means legal to meet this solemn and sacred responsibility.

Looks like we're picking up some speed. But now that Dear Leader has kicked the can down the road, is it all a bit of a waste, or misdirected? Is there anything we can do to ensure that our reps are getting the message that our sheriffs are sending to the wrong white house?
 
Law enforcement officers are just people like us. Most of them feel very strongly about the subject as well. The only law enforcement groups I could see supporting an AWB are ones in liberal stronghold states who genuinely believe that firearms are the problem and not gangs/criminals in general.

You'd have to be braindead to try and confiscate firearms from somebody unless absolutely necessary. I'm sure that Sheriffs don't want to put their men in danger over a bunch of political bullcrap.

The Sandy Hook shooting has prompted many recent discussions regarding gun control in the United States. Our own state of Oregon suffered a shooting at Clackamas Town Center in the Portland area last December and many of us remember with great clarity the murder of Officer Chris Kilcullen in April of 2011, and the Thurston High School shooting that occurred over a decade ago, killing four and injuring more than 20.
In response to Lane County residents’ many inquiries, I wanted to provide you with my stance on the issue.
As the Sheriff of Lane County, I have taken an oath to uphold the Constitution of the United States and the laws of the State of Oregon. I have upheld that oath for 31 years as a law enforcement officer in our community. While I understand the sense of urgency on behalf of citizens, I believe that any reaction, decision or response to issues that impact the rights of all people should be done so without haste and after careful consideration. Ultimately it is the Supreme Court, not any individual, that determines the constitutionality of any law.
As a member of the law enforcement community, I am supportive of our lawmakers evaluating the recent tragedies and engaging in discussions on how we can avoid the loss of more lives in the future. It would be irresponsible if we didn’t consider ways in which to make our Country safer. As law enforcement providers, we are tasked with conserving the peace and ensuring preservation of life.
As the details of the President's proposal emerge over the coming days, there will be many discussions on whether improvements can be made to increase public safety while upholding the Constitution and following the laws of our Country.
I remain committed to the preservation of the law, to the protection of life, and to you as residents of Lane County. We will continue to work together as a country, and as a county, to make our home a safer place to live.

Given the fragile and failing nature of our public safety system in Lane county, I am elated to receive a response which fully illustrates our Sheriffs commitment to his citizens' ability to defend both their families and property with firearms of their own choosing in accordance with the 2nd Amendment of our Constitution.

I appreciate his timely response in this matter.

I am glad to read about some class acts out there.

Tonight I read about one of our long time county deputies getting arrested for stealing painkillers at the jailhouse.

I've got a lump in my throat from reading this thread.
Seems like there are still some good folks out there that recognize that they are public servants and actually care about it too.

I hope this helps to drive the message home.
 
Our Sheriff here in Larimer County (northeastern Colorado) also issued a similar statement swearing to uphold the Constitution and refusing to enforce any federal laws that conflict with his sworn duty/responsibilities, etc. etc.

I wonder if these guys (County Sheriffs) are consulting with each other across the country regarding this matter? The wording of their letters to the President and press are remarkably similar.

Regardless, I sure appreciate their willingness to speak their minds. Thank God for honorable men in high places.

here in spokane wa our sheriff said he dosent want any new laws but our police chiefon the other hand (a nyc native) wants a full awb and gun regestration....we are a city devided.
