Anyone who thinks they weren't driving the stolen cars to their next robbery is crazy.
Well, it's unlikely that they were driving directly to another robbery. That would make for quite a busy night, no?

But really, that's irrelevant. Unless the homeowner had very direct proof that these guys were proceeding to another felony, (like perhaps they said, "Now we're going to go kill your neighbor Bill!"), then using lethal force on them is not going to be justifiable. And then it would be an uphill battle to establish the necessity of that act.

Explainable? Understandable? Sympathize-able? Sure. Lawful? The right thing to do? No.

I'm tired of these punks with extensive records having their way in our society. The revolving door for criminals and laws that protect them over a victim gives them confidence to keep doing this crap.
Then vote. Talk to your lawmakers. Work for justice system and prisons reform, etc. That's not a topic for this thread.

The laws are to protect you too. If I shoot you in the street and claim you were doing something bad (i.e. road rage incident) I am not covered, if someone thinks you did something you didnt do and comes after you, that person is not covered.

People are generally stupid and mob rule is bad. We have a justice system that protects us, and unfortunately it lets some criminals go.

The actual problem is many people are jailed for non violent drug offenses so we cant keep the violent ones locked up for as long.

Regardless, I am NOT in favor or people shooting in the streets to recover property. I look at a stolen car as an opportunity to get a brand new car.
 
Perhaps the best angle for him is CO 18-1-704.2.C which ties into CO 18-4-301 and -302.

But since the bad guy was leaving, he will likely still need to show that his life was being threatened either by, for example, bad guy pointing gun or using the car in a threatening manner.
