If you want the long version of the history of this problem, you can read it here: http://www.thehighroad.org/showthread.php?s=&threadid=31021

Short version of the history:
Bought a used Ruger MkII Government at the beginning of July, found it had barrel/reciever problems (barrel could shift in the reciever when heated to ~100 degrees F by the sun), so I sent it back to Ruger for servicing.

Today:
I found out from Ruger today that they are going to have to replace the barrel and reciever with a new set. The Ruger customer service lady said that she'd get me one from their warehouse (either a barrel and reciever with all my parts put back on it, or a whole new pistol, she indicated it would probably be a whole new pistol) made in 2002 or before so I'd be legal with respect to the handgun lock law, but I was wondering about the background check.

My dealer mailed the pistol back to Ruger for me, so Ruger must mail/ship the replacement pistol back to the dealer (rather than to me directly, if I'd shipped it UPS). (The replacement pistol wont be sent for a week or more, they have to send me a consent form asking for my permission to change the reciever)

Since this is a replacement pistol, with a different serial number from the one I bought, how are the background check and waiting period handled? Do I have to do the background check, or I am exempt since its a replacement handgun and the original gun is being destroyed? Neither my dealer or I have any idea on how we should proceed, he said he'd do some research (I assume that means call the MDSP and read his ATF law book), but I thought I'd ask here in case someone else had gone through this before.

Its a little time critical, since I go back to U of Delaware (on the totally opposite side of MD from the dealer that will be recieving my pistol, 3 hours away by car) on 8/31. So I'm hoping I dont have to do the waiting period and background check again, but I'll make a trip home if I have to in order to pick up my pistol.

You shouldn't have to go through another background check, I imagine that a notation has to be made to your dealer's original paperwork and a copy sent to the MDSP.

Made the (BIG) mistake of buying a High Point 40S&W a few years ago and after 3 trips back to the factory (all at the expense of the gun shop that sold it to me) the gun shop gave me a new one. No paper work or background check was done on it. Traded it in a few months later at another gun shop. The story doesn't end there. About a year after I got rid of the 2nd one the first gun shop calls me up and asks if I know the serial number (I keep a record of all of my guns so that wasn't a problem). The 2nd gun had been recovered at a crime scence & the BATF was tracing its history. The 1st gun shop had never recorded the serial number of the replacement in its records.
