im moving from florida to North carolina within the next month and had a few questions about NC carry law. I am still a registered FL resident and I will keep it that way to keep my FL concealed permit valid. So what makes NC carry different then other states? I read something about not being able to carry in a place that sells and consumes alcohol, so does this mean that I can't carry into my local pizza place if beer is sold there?

on a side note i am pretty excited about the right to carry in national parks now :neener: as i will be 5 minutes from Smokey Mtn National Park

You're correct about your pizza joint, no carry. NC CC laws certainly aren't the greatest.

I'm in NC and the Concealed Carry law prohibits concealed carry in "any establishment where alcoholic beverages are sold and consumed", "on any campus or educational property", "a bank or credit union", any "government office or courtroom", and "any property posted by the owner prohibiting concealed carry". That last one, of course gives you the opportunity to make the case to the owner or manager of the property that prohibiting a citizen's right to self defense creates legal liabilities that they may not want to shoulder in the name of political correctness...

Welcome to the Tarheel State!

First post here. I'm an NC resident, and will be taking my CCW gun safety course in January, and applying shortly thereafter for my CCW.

If I'm understanding this correctly, I can't walk into a grocery store, gas station, or restaurant with a concealed weapon? I was under the assumption that it was legal as long as the establishment earned 51% or greater of their revenue from non-alcohol sales...this would make grocery stores and restaurants OK, while Bars would be illegal.

So is it really "ANY establishment" that sells alcohol?

Kenny

thanks for the heads up, but Johnny Dollar's post sparked another question. If you go to an assembly and/or establishment where admission was charged, you can't carry a concealed weapon. Under this vague wording, I would assume this means movie theaters, circuses, athletic events, State Fairs, basically anything that requires an entrance fee. Is that a correct assumption?

NC's concealed carry laws are way more restrictive than I first assumed. I'm glad I'm figuring all this out before I apply to get a permit.

You are again correct! You can not carry anywhere admission was charged. NC does recognize your FL permit. If you keep your residence there you will not have to apply for a new one, but you will have to follow the NC law.

I live in NC.

My instructor was a Sheriff, pretty much said all they could get you for was trespassing if your spotted, he also said to not be stupid and you wouldn't have any problems.

Also....if you're carrying concealed correctly.....who is going to know?

Not that I'm implying you should break the law....I'm just saying.

Not to derail, but what the hell is the point of CCW if you can't carry anywhere?

These areas were already forbidden before NC passed its CCW laws. The CCW laws were passed with respect to these existing areas.

Better to check the law for yourself than take anyone's word.

Carrying a concealed weapon without a permit (§ 14‑269(c)) or carrying in a prohibited place with a permit (§ 14‑415.21(b)) are both Class 2 misdemeanors, punishable by one to six months in jail (§ 14‑3(a)(2)).

Anybody got a link to clear up carrying on a premise where a sign says you can't (like a mall)? I'm doing a lot of reading, but it's not crystal clear as of yet!
In VA, the mall signs mean little/nothing-if you're CC and they happen to find out, all they can do is ask you to leave. If you don't leave, then they can have you arrested for trespassing-not a weapons violation.

Trying to find out if the same is true in NC, or if NC laws state you cannot CC if the property owner has a sign posted?

Thanks for the document-guess I shoulda gone there first instead of slogging through my downloaded NC documents.

'Course, it never hurts to do so after getting the crib notes from someplace like handgunlaw.us!

I live on the border of VA/NC and have been doing more research on NC as I'm spending more time there-darn if they don't have some restrictive laws!

EDIT:
Now we're into the meaning of "proper" sign? I remember a fellow co-worker (his son is a NC State Trooper) once telling me these universal postings meant nothing. I think he may have told me the sign had to have the law posted etc, but of course I wouldn't take 2nd/3rd hand information without a grain of salt.
I have visited both Four Seasons/Greensboro and Northgate Mall/Durham, and both had no weapons signs posted near the bottom of their mall rules/code of conduct signs. Wonder if that's considered a "proper" sign?

Four Seasons Mall has proper sinage on the main entrances. However, if you come in thru JC Penny or Belts there are NO signs.

:what:

thanks for all the replies, what about carrying onto an indian reservation? i'll be pretty close to the Cherokee reservation too

what about carrying onto an indian reservation?

Well at's a whole 'nother mine field! Gotta do some research on that, but I'm pretty sure reservations have their own laws AFA CC.
Just a couple of NC links I have bookmarked-wouldn't hurt for you to do the same and download the pdf.

Ya shoulda kept coming north-you stopped 1 state short! :D
VA's got much better CC laws than NC-'bout the only unusual one in VA is you can't CC in an establishment that serves alcohol for consumption, but you CAN OC! Our nitwit governor vetoed attempts to correct that little screwup in our laws.

I live on the NC/VA border and have been doing more research on NC laws, and it's a minefield! Don't know what area you're headed for, but from what I understand the Raleigh/Durham area is even worse AFA CC.

Thanks Seabee, I just moved to NC and that looks like a nice resource to have.

One o' those deals huh-I'll have to remember that!

You wouldn't happen to know what a "proper" sign is, would you?
Jest wondering if any old sign will do, or if it's kinda like Texas where they have a lot of specifics AFA the sign (think it's a 30.06 sign?).

I don't want to get into a legal hassle, but the signs I saw at Four Seasons I wouldn't call conspicuous! They kinda remind me of a CYA deal-they were listed at/near the bottom of a sign inside the mall.

The keyword appears to be conspicuous. It's not like the Texas 30.06 which is very exacting.

Just spent a few minutes searching over at the Carolina Forum-someone said 'bout 5 years ago when they got their CHP they remembered reading there were specific requirements for the sign-red letters, so big, etc, but they said they went back and checked and apparently specific sign requirements have been eliminated (no mention made of what he KNOWS he read 5 years ago).

That would jive with what my former co-worker's son reported (NC State Trooper) as that was probably around 5 years ago. Guess the good folks in Raleigh have changed the laws AFA signs! :barf:

Coming to western NC from Florida is a mixed blessing. The (local) people are great folk, the country is beautiful and the climate is nice most of the time. :D

But the "half-backs" here are as big a pain as they are back home. One local fellow said it best, "I wish they would all go back up north to Florida, where they came from!" :neener:

The liberal cities of the middle and south of the state domonate state politics and our law makers are fully as honest as those in Ilonois and New Jersey. Our taxes and regulations are bad and getting worse, so are the state laws.

The state Wildlife Dept. is about 10% as good as our surrounding states and there are no reciprocal agreements for fishing any of the shared lakes. All the game officers are interested in is passing out citations, even to little kids and old folks they can catch in minor infractions of the letter of the regulations, which are many and complicated. :barf:

But, most of the local law officers are good guys, go figure that one out. Well, most of them are local boys who detest the state goverment as much as the rest of us! :D

Welcome up, anyway. Over all it's better than having to learn Spanish to order a meal in south Florida! Do your best to stay OUT of the Four Seasons Mall! :)

haha thanks ranger... i've lived in south florida for my whole 22 yrs so far, vacationed to maggie valley/asheville a few times, but i'm sure it will be a whole hell of a lot different living up there. and yeah from what all of you have said i'm not thrilled going from FL to NC as far as the laws go...FL is pretty liberal (or conservative depending on how you look at it) with the gun laws, guess there is one thing to miss in Florida :(

This has been of interest to me.......I was at Four Seasons last night and went in the entrance next to Ruby Tuesday (one of the main, general mall entrances). There is NO posted notification outside the door that says no concealed firearms. I looked around the parking lot entrances and could not find any either. I seem to remember they took those away after they had a shooting incident a few years back.

Anyone remember??

I think that's the same entrance I came through-while there are no signs on the doors, etc, 'bout 25 feet after you come in there's a sign with mall rules etc-think the last rule on the sign was "no illegal weapons" or similar wording. If that's considered legal notification, you have to "break the law" in order to find out what you're breaking the law (you have to enter the mall in order to read the sign). Nuttin' like a Catch-22?

Sounds kinda like one of those CYA deals-like the mall doesn't want it on the door so as to not lose business, but after you're already in the mall, if something happens they can say they have "properly" posted notices.

Doesn't sound kosher to me, but you may be at the mercy of the cop and judge?
