I think it's a trial balloon to get McConnell or Grassley to say "Yeah, we'd have a hearing for him" and then switching him out for a "real" nominee. If they hold to their commitment to not even hold hearings, then they'll be attacked for being "too extreme" for even a moderately conservative Republican nominee.

If the Judicial committee takes up a nominee, it's all over. The Democrats can use senate rules and parliamentary procedures/maneuvering to force a floor vote, even without committee approval. There are enough squishy Republicans that would go along that Obama would have his nominee confirmed.

And Sandoval has just declared that he's not interested even if he were nominated, so it's kind of a moot point.
 
Republicans should ignore the noise, and the media, on this one. The media will tire and move on to another issue by which they can bash conservatives

Asked about a potential nomination on Saturday, Sandoval told the Morning Consult, “It would be a privilege.” He called the Supreme Court “the essence of justice in this country.”

I can't imagine Obama is so desperate to nominate a judge that could actually get confirmed that he would actually nominate a qualified jurist like this.

High pay/prestige job for life.

The only real drawback is having to live near your work.

Supreme court justices are basically bulletproof.

We probably aren't going to get a better nominee, especially if the cra... I mean well informed citizens are intent on nominating an unelectable reality star to the republican ticket. An obama compromise nominee with an A rating from the NRA sure beats whoever hillary/Bernie will push through given 4-8yrs to do so.

You're assuming that this wasn't just a leaked trial-balloon. This president would never have actually nominated him, ever. It was a smoke-screen, nothing more, nothing less. But when Sandoval stated unequivocally that he wasn't interested, the smoke-screen blew back over the president's position.

This was a smart move by the Obamunists. Offer Sandoval via a leak and get Senate Republicans to say "well yes, of course we would consider Sandoval", then leak that a "flaw" was found during vetting (what do Dems care for maligning a Republican?) and offer up whatever crack addled lefty they really want and accuse McConnell of dirty dealing. Smart. Looks like Sandoval may have figured it out and stymied the Liar-in-Chief.

I would have been fine with his nomination. McConnell could have let the president nominate him, slow-walked the whole confirmation process, and then downvoted him because Sandoval is honestly not exactly super qualified for a Supreme Court seat. This allows McConnell the opportunity to demonstrate that his refusal to confirm is a matter of qualifications and not partisanship.
 
Sandoval would have been a disaster, hardly a Scaliaish nominee.
Although not perhaps the best choice if we want a hard line, constitutional champion, but I hardly think he would be a "disaster". Now, anyone Obama, Hillary or Bernie would put in place with a Democratic Senate? THAT would be a disaster!

Despite holding an 'A' rating from the NRA, Sandoval doesn't have 1/10th the intellectual horsepower to play in the Big Judicial Leagues that Scalia did - first on the DC. Circuit Ct of Appeals (w/ Ginsburg) and then the Supremes.

Not saying Sandoval wouldn't make a decent Fed district judge somewhere, and with some years to prove himself, maybe a Fed appeals judge later.

But this exercise was clearly the Prez trying to "tool" the Repubs by using one of their own rising "centrist" stars to do it.

No Scalia will be on offer. A devout atheist, proud lesbian, woman of color and double amputee is probably in the cards.
 
Aptman is more right than he may realize, Sandoval was a federal judge, and stepped down to run for governor. Sandoval wa s a Bush (IIRC) appointee, and was unanimously approved for the seat.

As pointed out above, the leak was just political theater. The question is just whothe administration is really trying to float.
