NFA Newbie Questions

Hoping to get some clarification as well as some step by step instructions, just to be sure I'm not missing anything or doing anything that will land me in a 10 year stint.

What I plan on doing is building a 300 Blackout SBR. But before the SBR I would like to build it into a pistol to use while waiting for the Form 1 to get back from the ATF. What i currently have is:

(1) A virgin billet lower
(2) Billet upper
(3) Handguard
(4) Sights
(5) Charging handle
Still Need
(6) Barrel
(7) BCG
(8) LPK
(9) Buffer assembly

How I understand the step by step is as follows:

(1) Get my lower receiver engraved with a unique serial to myself.
(Q) What are the rules and requirements for the serial?
(2) Get CLEO signoff, fill out the Form 1 and send in with the $200 check.
(3) Build the parts into a PISTOL, do not possess a spare buttstock during the wait for the Form 1 to get back from the ATF. (I do have other AR's with Buttstocks, that will share the same safe as the pistol :eek:)
(Q) Is this acceptable to file for the Form 1 and then build the pistol?
(Q) Can I build the firearm with a standard buffer tube so I don't have to buy a pistol buffer tube?

Does this all sound right? I know that I'm overthinking it but just wanted to get my ducks in a row before going down this road.

I was really hesitant in going the NFA route, as it pisses me off that we are being taxed for a constitutional right as well as getting a front seat ticket on the ATF's registry that doesn't exist. Have any of you weighed the desire to have a NFA firearm with the inclusion of your name on the list? I'm already a CCW permit holder, so I have already gone through the background fingerprinting for that, but this just seems on another level.

In regards to the CLEO sign-off, is there anything that I should be aware of? Do they ask you a reason for desiring a SBR, if so, what did you say or write?

And if anyone has any further information that might be helpful, please feel free to share. Sorry, I know this has been covered and covered, believe me I've read many threads, but just wanted to get my questions all answered in one thread. Thanks for everyones help!

Use the serial that is already on your lower (unless you made it yourself, then the serial number must be 1/16" and IIRC must be 0.03" deep)
You will have to engrave your name (or trust name), city, and state.

Building the gun into a pistol is fine while you wait. You don't have to use a pistol specific buffer tube, but it might be a good idea if you've got extra stocks laying around.

I would recommend going the trust route. Apart from the other advantages of a trust that you can find discussed elsewhere, having a trust also let's you efile your form 1 which gives you a roughly 90 day wait as opposed to 9 month wait. (on the other hand, if you file the paper form, you get a real stamp and not a PDF)

The background check isn't any real invasive thing. If you can buy a pistol you can buy a machine gun. The paperwork just takes a little bit longer. On the form 1 you do need to put a reason on there, but as long as you don't try to get cute with it and put "for the zombies!!!" or something like that you should be fine. "investment", "collection", and "for all lawful purposes" are perfectly acceptable.

As far as the "being on a list" thing... Unless you're taking extraordinary precautions every time you access gun forums or buy ammo/accessories online, if someone really looks they're gonna be able to figure out that you're a gun owner. You might as well play with the cool toys :cool:
 
As far as owning stocks search for constructive possesion here. It is a collection of parts in close proximity that can "serve no other purpose" than to make a prohibited weapon. In your case if stored with rifles you are legal.

I would go with a rifle tube with a carbine spacer and a SB15 non-stock :)

Some people will also suggest that you have your lower engraved before you submit paperwork. This way if there is an error its easier to remedy before sending the paperwork in. It makes sense but if you use a quality service you shouldnt have an issue doing it after you submit your paperwork. FYI Ive done all mine after the paperwork was submitted and never had a problem, I triple checked and the service I use does the same.

BTW all my SBRs have three lines engraved on them

CITY, STATE
SBR

the "SBR" part is not a legal requirement, just something I do in case someone gets nosy I have something to point to as Im fishing out the paper copy of the approved Form 1
 
As long as it is your first gun on a trust you can create the trust after the engraving. That has very little utility unless we end up doing each new gun on a virgin trust in the not too distant future :evil:
