NJ Man Defends Home From Burglars

(CBS) WEST PATERSON Three masked men attempted to rob Eucledes Moya's West Paterson home at around 9 a.m., Moya told police. His wife called from her car and told him that a vehicle followed her and parked in front of their house. That was when Moya reached for his gun.

According to Moya, he foiled an attempted burglary. "They tried to rob my house, three guys came in, one with a gun. I opened the door, and they tried to put a gun to my head,” he said.

The men did not know it, but Moya was armed himself.

Moya said, “I had a gun. He shot at me, and I shot back."

He fired his handgun a least four times but he wasn't sure if he hit the burglars.

"I was afraid for my life. They were shooting at me" Moya recalled.

But three of his bullets landed across the street, including inside neighbor Jessie Gurley's bedroom closet. His wife was in the adjacent bathroom at the time of the shooting incident.

"If I would have been in the line of fire, I would have lost [my life]," he said.

No way this guy had a CCW permit, and the rules about transporting a firearm are rather draconian (gun needs to be unloaded and locked in a separate container and unavailable to the driver). Also, I don't like the fact that his poor aim endangered his neighbors in the house across the street.
 
If you're talking about the victim here, I don't see what CCW has to do with it or transporting a firearm.

You don't need a CCW to to carry in your own home (even in NJ) and there is no mention that he went anywhere in a car. From what I understand, his wife called from the car and he was in the house. Why would the wife call him on the phone if they were both in the same car?

Happy he's OK - just too bad the burglers' bodies didn't stop the bullets that went into the neighbor's home.
 
Hi Davec, this incedent could have been so much worse eh? What are the laws in NJ, if he had hit his neighbour with a stray bullet is that muder or manslaughter.

In NJ, if the homeowner in this case had hit and killed an innocent bystander across the street, the burglars would have been charged with felony murder. That's on the criminal side.

On the civil side, the homeowner would probably be sued. The burglars probably wouldn't be sued because they don't have anything of value anyways.
 
For his sake, thank goodness he had a gun. At least he's alive. That's about all I can comment on without knowing more or seeing what happened and how it actaully went down.
 
West Paterson if I remember correctly he should trade his handgun in for a ma deuce. NJ gun laws suck he'll probably get sued. I'm glad I left.

In NJ I will bet my Life he will be chargered for discharging a firearm within city limits. It's illegal. An X New Jersian who didn't just walk but ran out of the most socialist state in the Country. And shall it sink into the Atlantic.

Followup:

Johnny Carrasco, 36, was apprehended by the Paterson police. He was one of three men allegedly involved in the home invasion attempt. Carrasco is facing felony charges of conspiracy to commit armed robbery, weapons possession and criminal attempt to commit robbery.

Still at large is Rafael Cabrera, 28, of Passaic, who police believe had the gun. The third intruder has not been identified.

Police said the homeowner, Eucledes Moya, had a semiautomatic gun which was registered and licensed. He has not been charged with any wrongdoings as many here expect (hope?) him to be.

Mr. Moya has not attended Thunder Ranch or studied under Jeff Cooper. His technique and response may not have been perfect, but he prevailed over multiple intruders. He and his wife are unharmed. A glazer and spackler can repair the property damage.
 
thats one reason why it helps to be proficient with your guns by going the the range alot. had this happened to me there would be a need for 3 body bags and the county coroner instead of a massive manhunt.

Range does not equal life But I will keep a eye out for your heroic deeds of markmanship if god forbid this ever happens to you. . Last I read NYPD has a 60% miss rate. Are you better trained than them?

its not about heroism,,,i never want that to happen to me. its about hitting your target, and i bet that i can outshoot most of the nypd.
 
This guy better pack his bags for Bolivia 'cause the NJ Stormtroopers are gonna be after him- no question in my mind that he's in deep doo doo
 
I am going to keep a close eye on this one, as I know someone that is related to the person whoms house/car was struck by shots fired in this case.
 
Preferably home protection should be a shotgun with a mix of slugs and shot.

Makes a nice bad-guy sushi and genertally won't go across the street.

But, a gun is better than a telephone when the lead is flying.
 
This happened about about a mile or two from my house. First I heard of it was here on this board. The houses in this neighborhood and surrounding ones are very close together. One of the first things I did when I moved in was replace my ammo with glasers. Personally I think West Paterson, NJ is a safe area. I work there and live in the next town over. Just goes to show you can never let your guard down. Once again I am thankful that I have two dogs that will buy me enough time to get a safe area and retrieve a firearm. Glad to hear no one was hurt.
 
Just thought I give you guys/gals an update. Moya is a personal friend and he okay, No charges brought against him by AG nor by anyone else. Paterson Police has yet to return his Glock 23. Someone mentioned earlier that he does not have a CCW license and you are correct but he was inside his house. His wife called him from her car because she has just finish dropping off the kids at school. This car had been following his wife the entire week prior to the shooting. He also frequents the range on a weekly basis, but as we all know hitting a moving target that is shooting back is not the same as hitting paper at the 25 yard ranges. And it was not in W. Paterson it was Paterson, it's 2 block away from Totowa, this is where the area Mayor, Councilmen/woman live at.

I don't know why he opened the door but if someone was following my wife for a week and she called me to inform me this is the same car was outside and then someone range the bell, I'd opened the door with gun/shotgun in hand as well.

Had he not opened the door who know what might have happened at a later date. To many possibilities to list, but 1 of them is for sure. These criminals would have been out on the prowl waiting for a easy prey.
