NSSF Issues Statement on 'Operation Choke Point'

NEWTOWN, Conn. -- The National Shooting Sports Foundation (NSSF) today issued the following statement:

The National Shooting Sports Foundation has been investigating the possible role of the federal government in influencing banks in their lending and business banking relationship decisions regarding companies in our industry. We have heard from several industry members that they had banking relationships terminated by their lending institutions.
We respect the right of financial institutions to make business decisions based on objective criteria. It is unacceptable, however, to discriminate against businesses simply because they are engaged in the lawful commerce of firearms, an activity protected by the Second Amendment.

NSSF staff has met with members of the House Financial Services Committee and members of the Oversight and Government Reform Committee concerning several documents that have surfaced from the FDIC labeling companies in the firearms and ammunition industry as "high risk."

As a result, we have worked with U.S. Rep. Blaine Luetkemeyer (R-MO) and expect that he will offer today an amendment to the FY15 Commerce, Justice, Science and Related Agencies Appropriations Bill, which would prevent federal funds from being used as part of "Operation Choke Point" or in any effort targeting companies involved in the lawful commerce in firearms.
We will continue to investigate the extent of any improper government involvement and will update our members as more information becomes available.

I recently spent some time with the senior management of one of the largest gun manufacturers.

They mentioned to me that guys like Rahm Emmanuel were calling banks and telling them to yank all their banking relationships with the gun companies.

This is not just happening to gun manufacturers. It's also happening to dealers (credit card processing services getting yanked).

It's a back door way to trying to kill guns by killing the financing.
 
I'm not a lawyer, but how it this even remotely legal? Doesn't it violate the equal protection clause? It's just so.....wrong.:fire:

Wow. That's a heck of a big deal.

They really will stop at nothing... e.g., when we have nothing, and can obtain nothing.. that's when they'll stop.
 
....and then the gun industry will be a cash and carry business, only furthering scrutiny from the IRS.

Forget the article, that was the most obnoxious paper, i.e., throwing total blockage via ads, other articles, moving things around, etc. etc. every few seconds, I've ever had the displeasure of reading.

Last time that'll ever happen. Even the NY Times lets you read an article in peace.

They claimed the authority, and we didn't immediately box them on the head until they had perforated eardrums, so...yes, they do have the authority at present. According to the WT article, it appears the obvious purpose of the law has clearly been perverted/exceeded, and is appears possible it is flatly being misapplied illegally.

Cut from the exact same cloth as the IRS tactics, so I am certain it stems from the exact same source. It'll be funny if we end up finding comms between the same familiar administration faces regarding this issue... Interesting times ahead.

Commercial banks have a great deal of leeway when it comes to how they loan their money. They use some very vague criteria, at times, for establishing credit worthiness. However, there is the Commerce Clause in Article I, Section 8 of the U.S. Constitution. There is also the Fourteenth Amendment, which guarantees due process and equal protection.

I would imagine that there are some pretty astute attorneys out there practicing banking law, who would be able to pursued this in Federal courts.

Rahm Emanuel, at the very least, is acting in a manner conflicting with the commerce clause, especially if he put pressure on banks to deny loans and financial services to companies and individuals who are otherwise qualified to borrow money, etc. It will take a tidy sum, and time to haul people like Emanuel into court. I'd love to see him and his cronies held jointly and severally liable for this despicable behavior, but to prove financial damages will be very difficult.

Usually when someone conspires with another to deny rights to others, lawsuits are filed before the phone calls are done. However, it seems that doesn't apply to the 2nd Amendment.
 
It's not just gun shops. This has given new powers to harass everyone. Folks might not approve of the adult entertainment industry, but people in that industry have been getting accounts terminated as well for no reason: www.cnbc.com/id/100746445

One might wonder if “Ammunition Sales” is on the list to prevent ammunition manufacturers from getting the necessary loans or credit so that they can expand production to meet current demand. :cuss: :banghead:
 
The National Rifle Association (NRA) is now reporting in much expanded detail, more information and links to government reports concerning this outrage. It seems that the Justice Department is up to its eyeballs in this and behind much, if not most of it.

House Report: "Choke Point" Targets Legal Businesses for Asphyxiation

On May 29, House Oversight and Government Reform Committee Chairman Darrell Issa (R-Calif.) released a staff report, The Department of Justice's "Operation Choke Point": Illegally Choking Off Legitimate Businesses? The report concludes that the true goal of the operation is to "choke out" certain industries, including legal businesses like sellers of firearms and ammunition, which the current administration considers politically objectionable.

The report follows the Department of Justice's (DOJ's) launch last year of Operation Choke Point, a wide-ranging investigation into banks and payment processors (the middlemen between banks and merchants in financial transactions). DOJ claimed the operation was aimed at combating mass-market consumer fraud by shutting down access to the banking and payment systems that are necessary for fraudulent businesses to operate. The justification was an alleged higher "risk profile" for consumer fraud or potentially illegal activities associated with some merchants or activities identified by the Federal Deposit Insurance Corporation (FDIC).

These "high risk" merchants are typically characterized by high rates of unauthorized transactions, consumer complaints, or evidence of state or federal regulatory or criminal actions against the business customer. However, with no explanation or justification, the FDIC's list of high-risk merchants and activities also lumped in ammunition and firearm sales (among other legal industries) with potentially exploitative or outright illegal enterprises. No one can reasonably suggest that firearms and ammunition sellers pose the same risks of fraud to banks and consumers as Ponzi schemes, cable-box descramblers, "get rich" products, online gambling, pyramid–type sales, debt consolidation scams, and similar schemes.

As NRA recently reported, evidence has been mounting that banks and financial institutions have been responding to the threat or potential for government investigative action and penalties by refusing to do business with legitimate law-abiding companies in the firearm industry. These decisions, moreover, are apparently being made without regard to the specific company's credit, criminal or financial history. Rather, they're predicated on the implicit threat that a bank's business relationship with a listed "high risk" merchant could be enough to trigger a federal subpoena and resulting investigation and lawsuit.

Earlier this year, Chairman Issa and Subcommittee Chairman Jim Jordan requested that the Justice Department produce documents and communications related to Choke Point. Their resulting review of the 853 pages of internal documents provided in response concludes that "Operation Choke Point is an inappropriate exercise of the Department's legal authorities, and is being executed in a manner that unfairly harms legitimate merchants and individuals."

Other key findings of the report released this week include the following:
· DOJ acted without the requisite legal basis. In furtherance of Operation Choke Point, the Department of Justice "radically and inappropriately expanded its own authority." Operation Choke Point's investigatory basis purportedly rests on subpoenas issued under Section 951 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989, or FIRREA. Yet this authority was intended to give the Department the tools to pursue civil penalties against entities that commit fraud affecting banks, not to investigate consumer fraud, much less private companies doing legal business.
· Despite assertions that the government's intended goal was limited to fraudulent activity, the report finds that DOJ targeted legitimate businesses. The desired effect was clearly to have legal merchants and legitimate businesses "choked off from the financial system." Operation Choke Point, according to the report, effectively transformed the FDIC "high risk" list "into an implicit threat of a federal investigation," a reaction the DOJ anticipated. The Justice Department was aware of the impact on legitimate businesses – that banks were dumping entire sectors of business deemed "high risk" by the government -- and "dismissed them." The proffered reasoning was that banks and "legitimate" businesses would sort it out, an expectation the report likened to claiming, "if one is not a witch, then they will sink rather than float."
· Rather than have offenders prosecuted on the basis of real and sufficient evidence in a court of law, DOJ misused its authority to "forcibly conscript banks to serve as the 'policemen and judges' of the commercial world."

· The report specifically cites the consequences of labeling firearms and ammunition sales as "high risk," resulting in law-abiding firearm merchants having existing bank accounts frozen or terminated. "The experience of firearms and ammunition merchants – an industry far removed from consumer finance fraud – calls into question the sincerity of the Department's statements" regarding the scope and goals of Operation Choke Point.

Whether it caused the ammo shortage or not, I say we all agree to spread the rumor, so those idiots in line at Wall Mart will get off their rears and raise hell with their representatives over this.

Geez, what happened to the days when certain banks would offer you a rifle in lieu of interest if you opened an account there? :confused:

I'm beginning to think gun ownership will almost be a thing of the past in another 2 generations or so. Between business refusing to do business with selected types, and the anti-gun poisoning of the minds of children in schools, print media, social media, etc., anti's will make ownership such a non PC thing, no kid will want one. Needless to say, the mentally ill who feel compelled to take others with them when they want to commit suicide aren't helping.

Going to have to work harder to get new enthusiasts into the fold.
 
When this gets it's day in court, I hope Obama and Holder are sitting in the defendant's chairs and go to prison for their part in this. They've been out of control since Obama took office and have been hiding behind the executive privelage badge for too long. They need to spend the rest of their lives in prison.

I wouldn't be so sure. With 100 million gun owners in the US and reports of more and more new shooters getting involved (especially women) I think gun ownership is going to remain strong for quite some time. Being such a polarized issue I often see comparisons to the Prohibition (of alcohol) in the early 1900's. People were passionate on both sides of the issue, but eventually most people understood that it was futile to try to control it.

So government makes the firearms business one of the most-scrutinized, most-regulated in America, then says that it's at high-risk for fraud.

This fits with the current administrations approach of ruling (pen and phone) versus going through legislative channels.
 
I'm sure the first the president hears about this will be when it's on the news. He will probably be shocked and apalled. Then announce that it was the work of rouge agents acting without orders. Oddly none of them will be fired.
