I don't think the memo has anything to do with the Montana legislation or with medical marijuana. It is aimed more at California's authority (and other states) to implement stronger state regs relating to clean air and minimum gasoline mileage standards. It is simply telling agency heads not to willy-nilly assert a claim that federal regulations preempt state regulations unless it goes through the full regulatory hearing process. Keep in mind, however, that if it is impossible to comply with both a federal and state law, the federal law preempts or trumps the state law in almost every case.
