Ohio Will Only Honor Arizona Resident Permit/License

The whole story. A gentleman contacted me stating he had contacted OH AG asking about AZ. OH AG told him he had to have an AZ Drivers License with his AZ Permit/License to be legal in Ohio. It states Resident twice. No other AZ Agreements state this with other states. No other Ohio Agreements they have with other states state this unless the state has it in their laws. (MI, SC & FL). From the paper work and confirmed by the OH AG they will not honor the AZ non-resident permit/license. Arizona started the paperwork and AZ put the Resident Only wording in the agreement. This agreement was signed in 2004.

The AG’s Office called me today after I sent an email asking them about all the permit/licenses they honored and if they would honor all those states Non Resident Permit/Licenses. I was just confirming this so I would have the correct information on Handgunlaw.us I never mentioned AZ etc. They confirmed they would honor all non-resident permits from states they honor except for Arizona. I told them it would be nice if they would put that info on their website. The AG’s Office told me they would forward my idea to put “Resident Permits Only” out from AZ on their reciprocity page at: http://www.ohioattorneygeneral.gov/Enforcement/Concealed-Carry/Reciprocity-Agreements If they will do that or not I do not know.

I am updating the site this evening late and all the pages I upload will have a date of last updated of 4/20/12 as that was my scheduled update date. I believed I should get it posted as quick as possible.

I know we're not supposed to feel surprised and/or righteously indignant that gun (and carry) laws are so abominably inconsistent and make so little sense, but ... wow.

"Hey, Eddie, I got a wacky idea! Let's throw the word "resident" in this reciprocity agreement letter ... just this ONE ... to keep folks on their toes! Hee hee!" :rolleyes:
 
My concern about this was the agreement was signed in 2004. It was the only agreement that AZ put Resident in. It only took me 8 years to find it out.

I have come to the conclusion that no one can stay within the law as we can't know what all the laws are. It is impossible for someone to know them all. Even 100 years ago most people never traveled that far from home and it didn't matter as much. Now we can be in any part of the country in hours.
 
I've had OSHA inspector types tell me the same thing. There are so many thousands of regulations, and so many millions of industrial and job-site configurations and possibilities that there is no way any human could ever keep track of them all, or properly apply them. They even conflict with themselves. An inspector can always find something if they don't like how you're running your site. Impress them in general and they'll overlook all but the very serious stuff.

When it comes to gun and carry laws, it should be so much simpler ... but I think the same general principle applies. Try...REALLY DARNED HARD ... to follow the law, and don't do stupid things. 99.9% of the time you'll be ok, as the police mostly aren't out looking to hassle you (and don't usually know the intricacies of these laws off the top of their heads any better than you do!) ... but there's that 0.1% that makes you sweat.

AZ only has one permit - there is not a Resident and Non-Resident permit.


So are you saying that it wasn't clear if you had an AZ permit but, for example, your drivers license was from another state thereby indicating you are not a resident of AZ?

That is correct. If you have an AZ permit you must have an AZ Drivers License or AZ State issued ID to legally carry in Ohio. Your address is also on the permit.

Thanks for clarifying.

I have an AZ permit and will be moving so I checked into it. I know I have to submit a change of address form.. but completly forgot that my address is on the permit when I asked.

I am in error. Your address is not on the Arizona Permit. It just has your name and physical features but no address. That will Teach me to look and not try and remember everything in my older and older brain.

No thumb/finger print (which they took when I got it)


But your concern is still valid.

Im currently an AZ resident with AZ drivers license.

If I have a AZ permit and move to (for ex) CA and get a CA drivers License then vacation in OH. The police will see my CA drivers license and AZ permit which in turn means 'out of state'.
