Out of state shotgun transfer to MD

Ok from what I understand if it is an adjacent state you can go there and buy it without a problem. But I think anytime you ship one it needs to go through an FFL. But then again take my knowledge with a grain of salt since I'm not completely sure.

you can buy from an ajoining FFL in PA, VA, WVA or DEL

or you can have an FFL transfer it in state to a MD FFL

purchase a shotgun from someone in another state.

Sounds like we are talking private sale/gift?

I keep one rule in mind when thinking about Maryland and firearms: Maryland would STRONGLY prefer that its residents not own firearms, and if they outright can't prevent it they will do all they can to make it difficult to purchase.

That said, the statutes on "regulated firearms" (handguns and "assault weapons") are less strict than on shotguns and (most) rifles.

Don't take anybody's word for it, go do a Google on "Maryland firearms statutes" and read up.

Federal law permits you to buy a rifle or shotgun, in person, from any FFL. Need not be adjacent -- that requirement was repealed at least as long ago as FOPA, maybe earlier. You cannot have a rifle or shotgun shipped to you by an FFL, although a firearm (including handguns) you already owned can be returned directly to you. You cannot buy a handgun out of state without having the transfer booked through an FFL in your state of residence.

What Maryland law adds to this, I have no idea.

I reread my post in the other thread and see I did not clarify that point. The other posters here are correct.

You may travel out of MD, purchase a rifle or shotgun from a dealer (I also believe private sales on unregulated long arms, but I'm fuzzy on it, so check - heck, check everything I say to be safe, in both the inbound and outbound state!) and return to MD w/o problem.

If an arm is to be shipped from somplace else into MD,shotgun, rifle, or handgun, do it through an FFL - I'd wager that it includes Black Powder purchases from, say, Cabela's as well. C&R permits are supposed to allow you to receive specific curio or relic arms to your doorstep, but in MD, this is a dodgy proposition and would likely be best done through a dealer (though your C&R should get you a nicer price).

Lemme whip out the red book here...

Article 27, Section 481A of the Maryland Code.

It shall be lawful for any Maryland resident to purchase a rifle or shotgun from a federally licensed gun dealer in an adjoining state provided the purchaser is eligible to purchase a rifle or shotgun under the laws of such state.

So if you want to go over to Potomac Arms in VA and buy an 870, you can do that. You still have to go thru the background check and fill out the 4473.

If you're shipping the gun in from a dealer in Washington State, for example, you would have to transfer the gun through a Maryland FFL. Same if you want to buy a gun from a private individual in Maryland - Maryland law requires ALL in-state firearms transfers to go through a dealer.

On that note - if you need a cheap, reliable Maryland FFL for transfers, send me a PM.

Can a Maryland resident, while on vacation in New Hampshire (for example) walk into a gun store, buy a long gun (870 shotgun, Ruger 10/22, Remington 700, whatever), fill out yellow form, pass NICs check, walk out with it, and drive it home (if he/she goes thru Vermont and New York instead of PRM)?

Just curious. Earlier replies indicate they'd be limited to PA, VA, W,VA, and DE for buying "over the counter".

What about person to person private sale from PA (or VA, DE, W.VA)resident to MD resident of long guns?

IIRC, MD thinks its sheeple are not to be trusted with ugly black plastic long guns that look scary, and traets them as if they were (HORRORS!) handguns. To not mix up the long gun question, let's assume long guns are the politically correct, safe, target shooting and hunting types.
