my husband was convicted of 2nd degree assualt a misdemeanor crime of domestic violence and has to surrender his hand gun. my question is can i his wife own a gun if i live in the same household

:what: Wait... WHAT?!

Sounds to me like you need one to keep you safe as you're getting away from him as fast as you can!

as I understand it: The rule with felons is that the spouse (or a housemate/child/etc.) can own a firearm, but the felon cannot have access to it - ie outside of the owner's presence, legally it must be stored in a safe that the felon does not know the combination to (or similar).

Yes you can but it MUST be under lock and key whenever your not around . I went through this with my son when he was out on parole and staying here . His PO came and inspected where I secured my weapons before he OKed him staying here . BTW onew of the requirements was they could not be store in an area where he sleeps or what would be considered a personal area for him , so think about a safe in the basement/garage .
