Something odd and not seen very often a .38 special that caused a pen gun to blow up. A darn good reason to not mess with pen type weapons !

When I saw the thread title I thought it said 'penguin.' :D

I don't know anything about pen guns, but that thing sure is busted.
 
:) real funny part is the a company named "penguin" did make many types of pen type weapons.
 
Pen guns that fire real ammo are illegal in the U.S. unless registered & tax stamped as an NFA "Any Other Weapon".

This has been so since the NFA was passed in 1934.

The one in your photo appears to be a modified flare gun not intended to be able to chamber or fire ball ammo.

Not true totally. I purchased "2" .22 folding pen guns a couple years ago at a local dealer ( he was part of the fight for the CT assult ban so he knew is shizzzit ) Long story sort, I paid $150 for the pair and sold them a year or two later for 250 and 350. Nice little $450 profit. I shot one in the back yard a couple times with the coirbli ammo (spelling waaaay off) fun but so was spending the $450 profit. So some were legal as non class III. I think they are being made again as I found a site a while back for them.
 
This is one of those IIRC things. Penguns that function as firearms while in the 'pen' configuration are the ones that the BATFE doesn't like. If the pengun has to fold or something then the BATFE is not so concerned.

The description makes it sound like a fed. agency (probably ATF) tried firing normal ammo in a flare pen to declare if NFA if it could, and it obviously couldn't.
 
Let's hope his sore fingers remind him to do some real work, and quit piddling around with stuff like this.

For what it is worth an old lady of my acquaintence was walking through a parking lot several months ago and seeing a nice looking pen on the pavement, she picked it up and shot herself through the hand. Fortunately, it was a .22 and went through the web of her hand without causing serious injury.

The police kept the pen gun so I didn't get to see it, but my guess is that it was a home made gun.
