Pennsylvania House moves to expand gun rights, keep pigeon shoots

It is an important preemption bill. It allows the pro-gun groups like the NRA to challenge in court local and city gun control ordinances when they are stronger than Pennsylvania's own laws. The Governor is expected to sign it over the objections of Philadelphia and Pittsburgh mayors.

"The gun rights bill, an amendment to HB 80, an item of metal theft legislation, had passed the state Senate last week by wide margins. It allows groups such as the National Rifle Association to stand in for local citizens in challenging gun city and county control ordinances stronger than the state’s own laws in court.

The move sailed through the House in an easy 138-56 vote Monday, the last day of the two-year session."

PA Governor Preempts Local Regulations

Today, Governor Tom Corbett (R) signed into law House Bill 80, the strongest firearms preemption statute in the country, at a public signing ceremony. This critical pro-gun legislation strengthens the state firearms preemption statute to further ensure that firearm and ammunition laws are consistent throughout Pennsylvania and allows citizens to seek legal remedies against localities whose gun control ordinances exceed state law. A much-needed protection for gun owners in the Keystone State, HB 80 will provide a way for responsible gun owners to hold municipalities accountable and responsible for infringing on our Second Amendment rights. HB 80 takes effect in sixty days.

Over the past few years neighboring Ohio went through this. Cities and towns were enacting all their own little sets of gun control legislation, the City of Cleveland being a major offender as well as other cities and towns. Now as a result of similar legislation signed into law in Ohio it becomes simple. Ohio law trumps all city and town laws. Those who have challenged the state law have all lost. This law makes good sense for so many reasons. I wish PA. the best on this good move.

Excellent news for Pennsylvania. Florida finally solved the problem with Statute 790.33 in 2011, fining local politicians $5,000 per offense, with attempts at local signs, "safe" gun storage and other shenanigans.

The signs are all gone now and the locals politicians have given up on other schemes. Money is the only thing they understand.
