A good friend of mine has been having a problem and had escalated to someone shooting through the neighbors house while occupied. They caught the guy and he has been known to have mental problems in the past (PD new about this). They also found the weapon used and arrested him. That was a little over a week ago. He just got word today that they let the guy go with a restraining order to not get within 1000ft of either my friend or neighbor. Well the guy lives about 250yds from my friend and about 150 from the neighbor. The judge said he could go back and live at his house, well within the 1000ft ruling. Now my friend, his family and the neighbors are living in fear waiting for this guy to flip out again and do something more. There is much more involved that I do not want to put in this forum. My friend has genuine reason to fear. This guy needs to be locked up or made to abide by the order of protection and find another place to live until the criminal phase has been completed. This is a major problem, letting those out who have shown they are a serious danger to society. I hope and pray that we do not read about my friend in the paper or see it on the news.

See thats the problem.

Why can't they all use the same measurements??

Any rifle shooter knows 1,000 feet is 333.3 yards, give or take a fraction of an inch.

Too bad judges don't have any requirement to know the first thing about much of anything like that.

I think restraining orders should be measured in Football Fields, or Basketball Courts.
Even the dumbest judge & defendant knows about how far that is.

Restraining order like that is nothing more than an extra charge the next time he flips out. "Protection orders" are a joke for anyone mentaly unstable or violent, if they're willing to kill then telling em to stay away won't do squat. Hope your friend stays safe.
 
just wondering , do you know how he got a gun in the first place , ? you did say he has a mental problem , right ?
 
Now let's not suggest falsifying any info.

But do keep an eye on him, and if he steps foot outside the house and it's not to get in the car and away from them, add to the paper trail.
 
I'm curious how he got off so easy after discharging a weapon. Regardless, I understand your frustrations. Unfortunately we have some serious problems with our system right now, and with certain political fields trying to take advantage of the recourse to pursue other agendas, it is unlikely to get addresses.
I was just in conversation with a friend of a friend of a friend, intentionally vague, about current HIPPA restrictions. It was brought to my attention that a patient undergoing treatment can announce his/her intentions of committing fatal harm to an unspecified group or random place of opportunity. Unless specific names, or specific places are announced by the patient, then it is a violation of law for the care provider to inform any third party. This is about as screwed up as it gets, in my opinion. We have a huge problem when the main issue at hand is ignored while other agendas are pursued in its place. The only legal course of action for the health care provider is an affidavit that will allow for a 24 hr hold for mental evaluation. After 24hrs the is no other option than to release the patient unless they agree to further treatment.
 
This is where a good strong neighborhood watch group could come in real handy.
This guy is just primed and waiting for the spark for his next violent outburst.
 
In the old days, the men of neighborhood would help him pack and show him the county line. There is nothing wrong with reporting a disturbing person. Perhaps him just walking around the front yard and scowling in the wrong direction would justify terroristic threat? The system has interpretations just as bizarre.

This is so unfortunately true. Hope everybody stays safe and this guy gets the help he clearly needs.

The subtle comic relief on this site from time to time just brightens my day. Your friend should certainly petition the ruling. Even if it doesn't change anything, there's a paper trail showing he tried to put distance between them the legal way, should anything happen.
 
Get a cheap video cam system.

Point it right at his house.

The judge has allowed an unfortunately unreasonable waiver of residence- but that extends only to the residence proper, not adjoining properties.

Take notes of all of his movements. All of his odd behavior. Keep the video backup. Keep police on speed dial- every time he leaves his residence in your direction, call them and report the violation.

Squeaky wheel gets the grease- be very loud. Either the PD will get tired of it, or the judge will quickly tire of the PD's response- either way, something will change.

Its entirely possible something in the story being left out may have some impact on the judges' decision- but thats fine, its already made anyway. Now make THEM live with that decision too.

Bullets flying at or into my house would have provoked a very stern response. Your friend did the right thing.
 
I would expect someone who discharged a weapon into a home that was occupied to then occupy a jail cell themselves. I don't get it.

Don't get all logical now.

The courts, jails, and LE are so overwhelmed right now with cases that short of something major typically little to nothing is done for stuff like this or theft or what have you. That's an observation, not an excuse, by the way, believe me I've been fighting some bad problems we've had lately with theft and some other stuff and it's frustrating as it can be.

If you talk to the beat cops down here the most frustrating aspect of their job is that they arrest the same people every week and within 24 hours they are out causing more trouble...never doing anything enough to end up on a charge that gets them jailed for a meaningful amount of time.

Yes the system is pretty much broke completely. Even on the "big" charges (murder for one) how often do you hear about the killer getting a lesser sentence, or a killer getting out of jail on parole(!) and such? HAPPENS ALL THE TIME!

This society has gone soft. The touchy feely hippie types that want to say "he's just a misguided but good person" about the worst scumbags have completely perverted our justice system...once the word is out that the "big stuff" only gets you so much while the "little stuff" gets you into practically no trouble...it's obvious what happens.
 
That shows exactly what is wrong with out system. That guy is known to mentally ill, has a gun and is still on the streets, besides the fact he shot at somebody's house. The correct response would be to lock him up. He has shown that he is a threat to society.
 
It's been broken for a long time. Back in the '90s my family was involved in a similar situation that was ongoing for years. The system would do nothing with the neighbors involved, even after the situation deteriorated to a legally justified armed response that thankfully deescalated the situation and ended with no lives being taken. LEO's showed up an hour after we called. Again no one was charged and we were left to spend the rest of the night knowing that those freaks were still out and about nearby. We found moving to be the best option, but in hindsight we probably should have moved even further into the sticks. We still have police officers and sheriffs crawling all over our property 2 or more times per year looking for someone, usually known criminals who've served multiple jail sentences. :banghead: the police we've talked to often express to us their frustration with chasing down repeat offenders. We were burglarized by repeat offenders last year. Those offenders have been in jail 1-2 times since they burglarized us, and are currently being held after they were caught in a vehicle full of a widow's belongings and armed with handguns. Who knows how long it'll be before they're back out terrorizing people again. It's a pity that nothing will likely be done with them until after they've killed some innocent person. The failing "justice" system is just one more reason to be armed whenever possible.
 
Were there additional firearms in the house besides the one used to commit the crime?
 
Don't know where he got the gun. There were many other weapons in the house. The one he used was a large caliber. Put it this way, it could have been used easily from 1000yds much less 1000 feet.

He demonstrated intent in many more ways than just firing into a home. This guy us clearly deranged. My friend was told he was going to be committed until the trial. But no they had to let him out.
 
This sounds like a bomb waiting to go off! Be careful! I would put up video cameras. Use a few real ones &hide them. Put up a lot of fake one's that he can see. This will likely set him off! Be ready for when it happens! Have a plan to deal with him. Hopefully he will be arrested! If not be ready to use deadly force, he probably has other guns or will get some! I learned along time ago. Better to control an explosion than just let it go on it's own! Good luck to you & your friend.Under the circumstances here in OR. that may be all you can do!
 
The video cam was how they caught him to begin with. That is not the problem. I just do not want to have to go look at the video camera to see what happened to my friend, who by the way is VERY capable of defending himself and family.
 
With the system broken here in OR. your friend may have to use his skill at H.D.! Unfortunately at this time the state & local L.E. seems not to care! And most of the judge's are corrupt we are pretty much on our on! Your friend needs to get as many neighbors involved As possible! This can be very hard as most don't won't to get involved! I hate to say it but I have to say you may have to look at video to see the outcome! I hope not! Once again Good luck! It also might be a good time to get an attorney, hope not as it could bankrupt your friend if things get worse. This is a bad time for us as a nation!
