Nope, she was legal.

I'm sure that others will be bringing in the proof in short order. There was quite a discussion on TFL at the time.

Guys, here's my take on this.

I also was on TFL when this came up, and if memory serves, the issue at the time was an alleged "straw purchase". After much confusion and ballyhoo'ed investigation, miraculously, the paperwork suddenly showed up, and everything was found to be in order.

Methinks I smell a rat.

Translation: Ol' Sarah decided that gun laws are for criminals, didn't want to bother with the process that the "little people" have to live with, bought the gun, and gave it to little Jimmy. When word got out, had to scramble to cover her tracks. She called her lackeys at the VPC, they pushed on the panic button on the Hill, and the ATF boys hustled to make everything alright, in an orchestrated maneuver to cover her ???. As they rifled (no pun intended) through the gun store's paperwork, the proper form gets slipped in the proper place, and... voila! One or two sound bites in the paper, six weeks of waiting for the dust to settle, and the public forgets it ever happened.

But if it were one of us that ran afoul of the paperwork...

Ok... I'm done, now. :D
 
There never was a straw purchase. There was no additional form slipped into the dealer's file since there was no need to. It is perfectly legal to purchase a firearm as a gift for another person. As far as BATF is concerned, the only paper required is the yellow form.

The law distinguishes between buying a gun "for" somebody else, and buying a gun to "give" as a gift to somebody else. I think the key distinction is who supplied the money...

No, the 4473 does not ask if you are buying for someone else. It asks if you are the actual purchaser of the firearm. The instructions for the form specifically mention that purchase as a gift is legal.

Maybe its just me but this whole situation kind of stinks to high heaven.

Sarah Brady "champion of gun control" goes to a gun shop to buy a 30-06 as a gift for her son.

After her rants about firearms "for the children" and all the pontificating about the dangers of guns in the home she feels it necessary to cross over and see what its like on the other side.

This may not be a proper comparison but Bradys gun purchase is like:

Jimmy Swaggart consorting with prostitutes,

Julia Child eating at Burger King

Sometimes folks go so far in their extremist views that visiting the "other side" has some kind of sick guilty pleasure.

Rational people with views backed up with facts and logic rarely
find themselves longing to see what it's like in the other camp.

Just my opinion...
 
The point is being missed here. Sarah Brady and company want to close the "loopholes" where:

A.) Guns are bought and given as gifts.

B.) Guns are sold or traded private party between two citizens, either at gun shows or in private homes.

C.) People are allowed to possess a firearm without completing a "safety course" "Background check" and the firearm isn't equipped with locks and the authorities don't inspect the home to verify gun is kept locked up.

Sarah Brady thinks all this should stop happening but shows she is not willing to set the example herself. Like all liberals, they LOOk like hypocrites, but they're not. They want to enact policy to control YOU while they are free to have CCWs (Peralta, Fienstein), freely buy guns they think you should not have access to buy freely (Brady) and have armed bodyguards (O' Donnel, Congressmen and Senators) while you are stuck not even being allowed to have a freakin' nightstick in your cars in some states or certain knives in others. They don't give a tinker's darn about the "kids" because if they did, they'd be all for executing child murderers instead of defending them. The "kids" are a Trojan Horse to push through their BS policies so that you'll be completely unarmed, catalogued, under total surveillance and penniless when they finally push through the REAL policy they're aiming towards. The Left wants you to THINK they're hypocrites so you don't suspect their more sinister motives. By appearing as hypocrites, it looks like they aren't smart enough to enslave the population. But looks are deceiving, aren't they? Just look what happened with the Trojan Horse...

You`re right... :eek: I stand corrected. I have seen and filled out the form soooo many times, and the only thing I really remember about it is to make sure to include my COUNTY OF RESIDENCE, when filling out the BUYERS ADDRESS part... :D

When they do get all they want...... unarmed, penniless, mindless sheep/servants to support the soul crushing weight of their Utopian Controlling Authority, where all men are equally enslaved and the rich.. er.., righteous are properly ensconced in their well paid, well protected and lavishly compensated roles as Demi-Gods?
and after all that - I'm not real sure if I was kidding.
Just what WOULD they do if they suddenly got ALL that they wanted.
Just thinking out loud.... and thinking......
Seems like I've seen this movie before.
