Selling across state lines

So if I wanted to sell a handgun to someone across state lines, I know that you must ship it through an FFL to be legal. But if I wanted to sell it to someone, is there a requirement that it must be shipped? Can I just drive it across state lines and give it to an FFL and he re-allocate it to a buyer in their state?

I guess I'm just trying to find out if I can circumvent the fees regarding having to find a FFL in my state just to send it overnight for something I can just transport myself for something that is less than an hour away.

1. There is no requirement in law that it be sent FROM an FFL... only TO an FFL (although, by their own choice, some FFLs will only receive firearms from other FFLs).

2. The overnight shipping is a company policy of UPS and FEDEX - not required by law. A private party can mail a rifle via USPS. An FFL can mail a handgun via USPS. USPS does not require overnight service. A whole lot cheaper than FEDEX or UPS overnight.

3. Yes, you can just deliver the gun to the FFL in person.
 
The last pistol I bought on gunbroker.com, from a private party, arrived at my FFL shipped USPS. FFL said, "does this guy know how much trouble he could have gotten into?"

Guess he's just been real lucky so far :uhoh:
 
I use an FFL when I ship only because I feel better about it going through his log book. He also charges me less for his service than it would cost me to ship o/n using FedEx. He uses USPS to ship.

You do not have to ship it through an FFL. This is a common myth, brought on by the economy, and carrier policies.

You are legally required to ship it to an FFL holder in the buyer's state.
 
My local FFL dealer charges me the same as if I sent it by FEDEX myself and that includes the paperwork to remove it from Michigan registration.

With perhaps one or more exceptions. Don't attempt to bring a handgun into N.Y. state as a non resident, or probably several other states which will immediately jail you if caught. Can't even take my pistol across the N.Y. state line to drop it off at the gunsmith. This needs a federal fix.

Yes, you must follow the possession and transportation rules for the state into which you are bringing the gun.

I didn't imagine that the OP was going to drive a handgun from OR to NY just to save shipping costs, but it is important to point that out.

That's how the law is written, yes.
