Selling gun on auction sitewith hi-cap mags question

I'm not pushing my own auction, as such I won't mention the gun type or auction specifics for fear of breaching the rules, however, that being said I do have a question. I am selling a gun with some hi-caps via an auction, if the FFL in the state the buyer is in tells me he or she can receive this type of gun and the included mags, am I legal, since they are the ones actually transferring the weapon to the buyer, or do I need to know what states I cannot sell to?

The way most auction site should work is that you sell firearm and then send to a FFL in buyers' State. FFL is the one that actually does the 4473 paperwork, FBI NICS, and completes the transaction for you at the buyers end. Buyer should check with FFL they are using at their end prior to purchasing as to what they can o can not have in their state is they do not know exactly.

I would call the FFL before I ship and find out if it is legal for him to do the transfer.

Try selling a fifteen round mag to someone in the wrong state and you'll find out that there is no such thing as "standard capacity".

"High-cap" is what a state gov says it is. Period. Whether we consider a fifteen round mag as standard or high capacity is immaterial.

Much as in the eyes of the feds the tomato is legally considered a vegetable when it is actually a fruit.
