Shootout ensues in robbery attempt

Two assailants picked on the wrong guy when they confronted a man exiting his car in his driveway in West Hempstead on Monday night, police said.

The 35-year-old homeowner was armed -- carrying his licensed Glock 9 mm pistol.

When one of the assailants fired at the man he fired back. No one was hit by the gunfire on Oakford Street, before the pair fled.

Nassau County police said one of the attackers, Jose D. Celis, 30, of Woodfield Road, West Hempstead, was arrested on nearby Elm Street after a search by Bureau of Special Operations officers. Police are still searching for the second attacker in the incident.

The attack occurred at 9:25 p.m. Monday as the homeowner exited his car and was confronted by the two men.

The victim's name is being withheld due to the nature of the assault. Police said the man was a "licensed pistol holder," but could not immediately say if his pistol license -- or the attempted robbery and assault -- was related to his business.

Celis was charged with second-degree attempted murder, first-degree attempted robbery, first-degree criminal use of a firearm and second-degree criminal possession of a weapon, according to police.

He is scheduled to be arraigned Tuesday in First District Court in Hempstead.

They probably would have arrested him by now if that was what was going to happen. As long as the defender doesn't get arrested and the evil doers are tried and put in prison Justice will have been done and that would make me happy. There isn't much happy news on the justice front lately.

What does this part of the statement have to do with anything? If the license and/or attempted robbery and assault have nothing to do with his business does that mean it could be an "unjustified" use of the Glock and thus unlawful???

I think the police are just saying that they couldn't answer the journalist as to whether the license was issued because of the nature of his business or if he was attacked because of the nature of his business. I think it's a two part question trying to find out what the man's profession was for more info.

He really better lawyer up quick. It may be a justifiable shoot but that doesn't mean the DA won't try to crucify him anyways saying "You shouldn't have shot in the first place, let the criminal do the act, be morally superior while staring down the barrel of a gun, just COMPLY!!".

I read in our local paper about an early morning shooting in a bar. Apparently two people got into a fight around 2am. The bartender shot both, one died. The bartender was indited for aggravated murder by the grand jury.

Every time I read of incidents (at 2am) (Or in a Bar at Plus midnight)
I cringe. Remembering my young Dad years, those years when you had to pick up kids, and dodge the odd drunk on the public roads.

Or even when you had to point out the rules to the new boy friend! You will be home by... Once they realized the "Bowling Trophy's" were shooting awards, no problem with compliance (we know it means nothing really, but to a young man meeting me for the first time, it did) plus my Daughter could call me anytime, and I would go and bring her home, sans Boy Friend, he could puke in the house he drank the booze in.

Carrying firearms is an awesome responsibility, guiding a two ton vehicle down the road is as well! Drunk in charge of a vehicle, or a CCW permit, you loose that privilege.

Just do not through the baby out with the bath water, as one poster has all ready stated.

How is this even relevent? Are licenses issued in NY w/ a stated purpose? If so can you get in trouble for not using your gun for a stated purpose?

Example: If guys license said it was issued to protect him when depositing cash from his business at end of day into bank and he was robbed at his home for his personal property can he get in trouble?

May-Issue is a joke. Here is my purpose "to protect myself, my home, and my family from any and all threats occuring between 12:01AM and midnight at my home, car, business, or any other location not prohibited by law".

Its just that in this day and age the reporters were unable to determine his occupation (ie jeweler, bodyguard...whatever NY thinks justifys CHL ). Sounds almost like he was a spook or employed in some gov't agency - that and the fact he hasn't been charged - on the spot.

It appears the police feel he was justified in his use of the firearm. Though it also brings up the point of hitting your target versus shots going wild:

Judy Laufer was just feet from her bedroom window chatting on the phone when the stray bullet pierced the window and lodged in her toilet tank -- flooding her bathroom and ruining her new kitchen below.

If she'd been hit, you can bet he'd be charged. I wonder how long it will take her to sue him?

Yes.

Probably. They have homeowner licenses, and if you carry your gun out of your house, except to the range, I imagine you can be in trouble.

thing is, i'm guessing she's not in the bathroom where the toilet was struck. that means that she hears a shot and the bullet is already lodged in the tank and water is flowing everywhere. i doubt her first reaction was to go turn off the water.

either that or she is going to sue the guy for damages and wanted to make it worse.

I think they're just trying to report that they don't know of a motive for the robbery. On second thought, I'm probably giving the reporter too much benefit of the doubt.

Reminds me of my young and stupid days. I worked part time as a bartender in a sports bar. We had a competitor about three blocks away, I knew the bartender there very well, he had just returned from Nam , minus an arm. We heard the sirens, and saw the flashing lights, so I headed that way somewhat concerned about my friend. I arrived just they loaded a biker wearing his colors into the ambulance, he had decided to be a tough guy against my one armed friend, who had shot him six times with what I believe was a 22 because any larger caliber should have killed him.The whole story was that my friends girlfriend was at the bar and the biker was coming on strong to her. My friend told him to layoff her and the biker said no one armed weiny was going to tell him to do anything and started across the bar, whereupon my friend shot him six times. Harris county grand jury no billed him, citing legitimate self defense.I was later told that the biker was found to be in possession of a knife and a blackjack.

It's just a good thing that the man had a weapon for self defense. In every sense, it was a very close call for the man. Whew!
