SSA proposed NICS rule

Today's Wall Street Journal has an Op-Ed on this topic. The author, a psychiatrist, says about 75,000 persons would be affected -- those people with mental disabilities who are deemed incompetent to manage their own benefits. I don't pretend to be knowledgeable about this issue, but I'm passing along a link in case anyone's interested. Unfortunately, you may not be able to access the article if you're not a paying subscriber -- and my understanding of the High Road rules is that I can't copy the entire piece. Here's the link: https://www.wsj.com/articles/dont-repeal-obamas-modest-gun-limit-1486426292

Yes, the author is a typical Obamunist. Due process should be suspended because the Obama rule is "sensible". No acknowledgement that the "sensible rule" is illegal or that if it were so "sensible" it should have been passed by the people elected to make laws in the this country.

The arrogance of these people is extremely galling. The rule may indeed be sensible. All 75,000 people the author indicates, and maybe many more, may very well be of a mental state that would merit adjudication as mentally unfit to possess firearms. I have no idea. But I do know that Americans who have not been adjudicated mentally incompetent have a right to keep and bear arms. And I do know that removing that right requires dues process, the opportunity to face one's accuser, and that the government prove that the person in question may not exercise that right. Obama's rule utterly disregards those facts, is discriminatory in the extreme, and constitutes illegal restraint of civil rights. How these so-called "progressives" square their perverse ideology with such action is beyond mystifying. It's as if they have no basic concept of logic.

Now if only the same regulation regarding veterans that have designated payees would be reversed. I don't seem to remember such an outcry about when they did this to vets compared to now with SSA.

There was an outcry, but Congress had no recourse. Congress passed at least three CRA's under Obama and all three were vetoed. The rule you refer to was made prior to the cutoff date that would allow a CRA by this Congress. The only ways for the rule affecting veterans to be undone is litigation (sue and settle) or new rule making by the administration. The latter is entirely feasible. To effect it, veterans organizations should urge all those who voted for the SSA CRA (which included a number of Democrats) to lobby the administration for such and should themselves take the matter up with Shulkin the new VA Secretary. It will take some time as it would require a new rule making process to rescind the rule but it is eminently feasible.

The Senate voted today on H.J.Res.40, Providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the Social Security Administration relating to Implementation of the NICS Improvement Amendments Act of 2007.

President Trump signed the repeal of this blatant rights ban. As with so many of these so called "common sense, let's keep the firearms out of the hands of the crazies, etc." is nothing more than another gun grab and to beguile the public into accepting it. (even had members here indicate support for Obama's EO).

Anyways, another gun grab gone and good riddance.

The SSA gun grab was rescinded via Congressional Review Act. This requires only a simple majority of House and Senate. The Veterans rule does not qualify for a CRA as it was done outside the qualifying time window. Therefore, this is a bill in Regular Order. If it passes in the House, it will require 60 votes in the Senate. I am not confident there are 60 in the Senate, so this Bill has a long row to hoe.

Pretty telling if they can't muster 60 votes for something this minor (both the Republicans lack of even the faintest commitment to pro-gun issues as well as the Democrats' dogged determination to oppose them in every possible manner)

Smallest of small potatoes...and they still can't get it done. <mafioso> "But where else ya gonna go to, huh?" <mafioso>
