Guy shoots someone trying to reposess his son's snowmobile, gets a relatively light sentance for his stupid gun move, and then REQUESTS a longer sentance just so he can go to a prison that allows SMOKING!!! So many bad decisions in this one that it boggles the mind.

Smoker opts for longer prison term
Canadian couldn't handle smoke-free jail

Reuters

WINNIPEG, Manitoba - For a 73-year-old Canadian man, 20 months in a smoke-free jail looked just too long, so instead he took 24 months in a prison where he can smoke cigarettes.

Angelo Foti was sentenced to 20 months for shooting and wounding a man in his backyard who was trying to repossess a snowmobile sold to Foti’s son, the Winnipeg Free Press reported on Tuesday.

In court on Monday, Angelo Foti was agitated when he realized the sentence would mean he would be in a provincial jail, where smoking is banned, the newspaper said.

Foti’s lawyer pleaded for a 24-month sentence instead, which means the man will go to a federal prison, where smoking is allowed.

In accepting the longer term, Foti, a dedicated pack-a-day man, ignored the wishes of this family.

“Dad, they’re just cigarettes -- give them up. Quit smoking: you’ll be healthier,†his son Angelo Jr. said in court. “Just take the 20 months.â€

I hope that 73-year-old Canadian knows what he just did to himself. Jail and prison are totally different...he may just become someones wife in prison. All for a plant...

Am I the only person who is not surprised? Folks will do ANYTHING to smoke. On airplanes they rush outside of secure zone for a last puff and on arrival run outside before getting bags to light up again. Every now and again one attempts to disconnect alarm in bathroom.
My question is IF he had no knowledge of repo man. AND just tried to stop him/was threatened why is he in jail?

A thought I just had...

...in Texas you are allowed to defend proeprty with deadly force, right? And repo men are allowed to 'steal' cars. How often does this combination turn out bad?

I wasn't aware it was legal to defend anything other than life with deadly force in any state.

Besides, if you don't meet payments, it is the bank's property, not yours.

And repo men are allowed to 'steal' cars.

It's not stealing if it is not your to begin with, people who don't pay what they owe when they should, it's quite simple.

Maybe he thought it was a robber and not a repo man... maybe he had smoke in his ears when he tried to identify him... who knows?

PC 9.41: Protection of One's Own Property

PC 9.42: Deadly Force To Protect Property

PC 9.43: Protection of a Third Person's Property

All of the above define the right to use deadly force to protect property and "theft during the night time" is one of those reasons.

Will e-mail PDF version of Texas' Current CHL laws to any who need them or have doubts.

God Bless Texas!

On top of all that, where is the "4 year mandatory minimum sentence" that the Liberals promised for violent gun-related crimes when they rammed their registry BS through Parliament? In Canada, it is absolutely ILLEGAL to shoot someone, except as a means of protecting one's own life. :fire:

Nemesis is right, in Texas you can shoot theives in the night. I've talked with repo guys from TX who say getting shot at is not an uncommon thing at all to happen. They were bulletproof vests, and are are good at being quick at repos.

Reading the subject line, I thought you were going to tell us someone tried to do some parlor gun twer'ling tricks with a glock and lost a foot :what:

But this is almost just as bad...:banghead:

Texas repo men developed a fast operating hydraulic lift that 'hides' in the bed of a pickup truck. The lift has 'spikes' that connect to the underside or bumper of a vehicle to hold it long enough to lift it and run far enough away as is 'safe'. Then the driver/repo man can take the time to chain the vehicle to the boom.

I went out on a couple of these runs when I was much younger and not as wise with a couple of friends in the business. If you get it too big a hurry the vehicle being towed can fling off the boom and get away from you. It makes for even more excitement as the repo-ee is chasing you...but then again, I suppose it's like a lizard shedding his tail to get away.

Now that I'm older and wiser, I sure appreciate darkness and I distanced myself from those friends years ago.

Regards,
Rabbit.

I once worked with a feisty old 77 year old who smoked 2 packs a day. He was wiry and physically fit. His doctor convinced him to stop smoking- for some reason he took his doctor's advice. Within a year he got fat slowed down, and looked very pale- he died of a stroke within a year of quitting.

20 months in a nonsmoking jail could be a death sentence for the 73 year old, while he might survive an extra month or two, and a harsher environment if allowed to smoke.
