Shots Fired During Home Invasion

Authorities told News 2 an elderly couple confronted a gunman in their kitchen. The result was a hail of bullets and one man in custody, but amazingly, no one was hurt.

Wearing handcuffs and smoking a cigarette, Dwayne Kirk told News 2 he didn't do it.

"Innocent till proven guilty."

The 21-year-old said he didn't break through the back door of a home. He denied shooting at the seniors, who live in an upscale Columbia house. Mr. Kirk denied stealing a laptop, and he said he knows nothing about some stolen stereos.

"None of that belonged to me."

And he doesn't know anything about the two hand guns covered with blood. Police said he cut himself on broken glass.

"I didn't have no weapons. Found them on the ground."

While Kirk denied everything, Columbia police said he's implicated himself in Thursday morning's crime spree

"Lady woke up and saw him with the gun. He said he was the police."

Police said the 72-year-old homeowner woke around 5:30 Thursday morning when she heard a gun shot in the kitchen.

Detectives said Kirk was in the kitchen and fired off a shot from his .357 handgun. You can see the hole in the front of the freezer. It actually went all the way through, blowing up a bag of vegetables.

Detectives said a bullet also ricocheted into a chair - a charge Kirk again denied.

"If I want to shot at you, I'll shoot at you. Not gonna shoot your refrigerator."

About then, detectives told News 2 the 80-year-old home owner fired one shot at the alleged home intruder, who reportedly fired back at the world war ii veteran five times.

"Luckily no one was hit during the gunfire."

With News 2 cameras rolling, Detective Kenny Brady located one of those slugs which bounced off the home. Kirk was arrested minutes later in a field behind the home. Now he has advice for other would be criminals.

"Stay out of trouble. Go to work. Get a job. Might not be with handcuffs on you. Look around see all these police cars, can't get away," Kirk said.

Dwayne Kirk is charged with aggravated assault and burglary. We're told he has a previous criminal history, and more charges against him are very possible.

ummm, cant get away from something you claim you didnt do? glad the WWII Vet is okay. he needs to stick around a few more years and pass on his wisdom to the younger kids.
