Austin woman shoots attacker in the face

An Austin woman credits her handgun and her own quick thinking with saving her life after she shot a man who was trying to attack her. Leonie Burgos said the man scaled a fence outside her apartment near Barton Skyway and South Lamar.

When Burgos saw the man jump the fence, she ran inside and grabbed her .38 caliber pistol. She went back outside to see if the man had left. She said that's when he attacked her by tackling her to the ground from behind.

Bergos said she shot the man only after trying to scare him with the gun first.

"First I tried to point it up in his face so that he would see that I had a gun so he would take off running," said Burgos. "But he didn't."

Burgos said the man continued to hold her down and the two struggled. She said she pulled the trigger three times and did not know if she hit the man. He ran away before police arrived.

Thirty minutes later, a man went to the emergency room at Brackenridge Hospital with a gunshot wound to the face. Hospital personnel called police. An arrest warrant said Christopher Benavides,20, told police he intended to steal the woman's cell phone and sell it for cash before he was shot.

Benavides had two warrants out for his arrest at the time of the attack for criminal trespass and criminal mischief. He now faces a charge of robbery by assault, as well. Burgos is not facing any charges.

I'm having more and more trouble understanding why burglars and home intruders justify putting their lives (and faces) on the line in plying their trade. Don't they get it?

Especially in Texas!

There's something about that that interests me.
 
The punk was obviously strung out and it is good that Leone had her gun. See D.C. and Chicago or any other gun ban city: Citizens can successfully protect themselves wit a gun. :cool:

No, of course they don't get it because more than 99% of the time, they don't meet such a response and even when meeting armed response, the people with guns often are unwilling to shoot, can't work the gun properly, or can't hit the broad side of Houston. The chances are still very good for the bad guys that even when meeting armed response, they won't get harmed.

They don't get it just like gun owners don't get the fact bad guys just don't get it. Everyone is in denial.

Just like most of the public, bad guys have the attitude of "It won't happen to me." Think about it. Even people in Iowa who have been flooded out previously were apparently 'surprised' by the June flooding! People who live in bad neighborhoods are often surprised about being robbed or attacked.

These attitudes and the fact that so few bad guys are actually harmed by good guys is why crime rates don't really change. There isn't enough bad guys getting put in a bad way (either by harm or being stopped enough times from committing crime) for it to make a difference. Where guns do make a significant difference is on the individual basis. The woman protected her own life.

You cant always act in a tactically sound manner. It may be that she should have locked herself inside and called the cops, but why? Why should she live in fear? She went in to get her equalizer and then went about her day. In my eyes that is the reasonable thing to do.

She should not face any charges in my NOT so humble opinion. Can you spell V I C T I M? CRIMINAL?

People are tired of having to LOCK themselves up in their homes just because they have scum bags aka criminals OUT there waiting to steal, rape, kill and/or attack them and/or their loved ones. The weak, the ill, the elderly, ladies, children and even MEN! They are tired of home invasions too!

By the way, home invasions are UP all over the country even in those safe 'milk toast' areas from the suburbs, small towns, rural, semi rural and even in the cities... nice places not just 'slums' or bad parts of town. YOU can read about this on various gun boards and on internet news websites. (Leverguns.com has a story about this. I do not belong there but I read that board on and off. A 'safe area' is where one home invasion took place. The man had a problem with 911 too.)

I was talking to an elderly friend of mine back east who used to live about 3 miles from my rural home and land. There is a BIG increase in crime and a BIG increase in some drug traffic. The people who were involved in this were from well known, upstanding citizens and families... NO kidding. NOT just outsiders or city slickers as they like to call some people. THINGS are not the same there and with the way this country is going... you will see even more crime, more street crime and NO offense - home invasions - even in nice parts of town and in SAFE states to some people. Crime is crime and it can happen anywhere, anytime to anyone... least of all when you expect it to happen.

Too bad that they bad guy is still breathing. It would save the taxpayers some money!$! NO offense.

On a more serious note, good for her. She felt threatened, got her weapon, then proceeded to clear her property. When attacked, she defended herself well. I wish all stories would end this way.
 
Good shoot. Some of the stuff leading up to it, eh, not so much. But good shoot nonetheless.

Sick of scumbags

The scumbag who attacked this lady had 2 previous warrants out for him!! Who'd a thunk it!! He doesn't seem to obey laws very well, now does he. Not to mention all of the other crimes and misdemeanors that he has done and got away with, since I doubt that even these crimes he was charged with are his first. I despise all these criminal types that see the rest of humanity as their prey. The world would be a better place with more armed, good citizens who put these scum out of our misery.
 
The way I read it, she was outside, saw the guy climb the fence, and went inside for her equalizer. She went back outside not knowing if he was still there, ostensibly to resume whatever she was doing. He jumped her from behind, and wound up getting shot over a cell phone.

Good for her, bad for him, and I'm just sorry the taxpayers will be paying for this mental midget's upkeep. He ought to be on a prison farm, growing his own food and earning his keep, but heaven forbid we make these idiots sweat. That would be inhumane! :rolleyes:

There was no mention of caliber, but I'm betting it was something pretty dinky.

Addiction to drugs is a very powerful thing. It'll make you do things you'd NEVER do with a little common sense.
 
Burgos is not facing any charges.
Unfortunately, it is a sad commentary on the political climate in the United States today that this statement is even necessary. That should be a foregone conclusion.
