Local teevee news reported developments in the story below last night. Oddly enough I can't find mention of the update online.

Seems the shooting took place in an area where the pine straw had been leased for harvest, and where thefts of the leased commodity were rampant. The alleged shooter was reported (not by WRAL, but by another station) to have 'fired warning shots into the air and when the bullets came down they struck Batista.'

Ooooooooooookaaaaay.

Wonder if a jury would buy that?

Civilian Shot Near Fort Bragg Dies

FORT BRAGG, N.C. -- A civilian, who Fort Bragg military police found shot Tuesday night, has died, a spokeswoman for the military base said Wednesday afternoon.

Authorities said 44-year-old Francisco L. Batista was shot two times near Mott Lake in the Fort Bragg training areas while he was raking pine straw. He died at 2:20 p.m. Wednesday.

There are no suspects at this time. The case is still under investigation.
 
Can't see any jury buying that - what do you think the odds are of being hit twice by bullets in that fashion? I think you have a better shot at winning the Powerball three times in a row :)
