The Manhattan millionaire who used his bodyguard's gun to scare off a burglar without firing a shot has been sentenced to 3 years in prison. Guess he wasn't rich or famous enough.

George Bardwil, a successful businessman, was alone in his Manhattan apartment when a burglar broke in. Bardwil, 60, waived a gun at the intruder, who fled – which is precisely how home defense is supposed to work. Bardwil then called 911 to report the incident, only to find himself arrested on suspicion that he possessed an unlicensed gun. His bail was set at $250,000, with the high dollar amount possibly connected to pending charges against him for allegedly assaulting his ex-wife.

According to Bardwil’s attorney, Michael Bachner, the .40 caliber Sig Sauer is legally registered to Bardwil’s bodyguard, and is kept in a secure box in Bardwil’s apartment. The prosecution concedes that Bardwil has been burglarized several times already and that Bardwil used the gun in self-defense, without firing it.

I do hope this gets overturned in appeals. It would be different if he chased the burglar and shot him in the back. 3 years, really?
 
Welcome to NYC, the model for the rest of the country in Bloomturd's mind. I'm telling you the time for secession is near. Any moron DA who brings this up to court and any judge who rules against the guy aren't American.
 
My brother lives in the city, I live in the country. He target shoots at my house so he leaves a few of his guns there for when he comes over. I get burglarized and happen to be closer to one of his guns than my own. I grab it, the burglar sees me do so and takes off. No shots fired. I get 3 years for it.
NYC is setting a very scary precedent with this insane ruling. I pray that this gets overturned by an appeals court.
 
If only he'd followed Uncle Joe's advice and used a double-barrel shotgun...and fired both barrels into the air, he wouldn't have been arrested. :rolleyes:

Seriously, though, this is a sad situation from what I'm seeing. This guy should be getting applauded for having the restraint to see that the suspect was fleeing and not shooting him. Considering he's getting three years, I'm glad he didn't shoot...
 
Unfortunately, this gentleman is not quite a poster boy either, as he's racked up charges over the past few years for assaulting a maid and assaulting his spouse.

This, of course, does not have much to do with the case at hand. So, while the once-great NYC, its laws, and its judicial system are pretty much irretrievably FUBAR, this is not quite the case of an angel victimized by the system (though the system did manage to "lose" his $187,000 jewel encrusted belt buckle when he was locked up for assaulting the maid in 2009).

If a guy with this kind of resources can't extricate himself from NYC's legal morass, I fear for the average Joe Citizens who gets caught in the quagmire.

The only thing I miss about NY is the pizza.
 
In New York you are not allowed to touch any handgun without a pistol permit. Can't even go into a gun store and pick one up unless you have the permit. At the least he was probably charged with illegal possession of a firearm by doing what he did
 
anybody that calls the police after an incident like that is as dumb as a pile of rocks. when you call them as a victim you are lucky not to be tased beaten shot or arrested. I hope all will learn a lesson from this

I read that too at another source and wondered if maybe he was prohibited from possessing firearms because of it. It may have been a condition of his probation and why he got three years on this offense.

He hasn't been tried or sentenced yet. The article says...

"A man faces three years in jail because the gun he used to chase a burglar out of his home was unlicensed."
 
This is absolutely ridiculous. I grew up in New York and I can tell you first hand, they'd (politicians) would *rather* you die at the hands of a criminal than vice versa and it sickens me. They'd be happy if we were all lambs.

When the hell did self preservation become illegal? Going to jail for defending yourself?? I'd really like to hear what the NYPD and Bloomberg thinks the man *should* have done. Really.. it's much easier to say "well, that's wrong" than it is to offer an actual solution.

I smell something here besides NYC's insane gun laws:

Was he on bond on the pending charges and a prohibited person under the terms of his bond or did he have a restraining order against him from the ex-wife that would have made him a federally prohibited person?

I think there is more to the story then mrconservative is telling us in his blog.
 
So, I guess the lesson is that of you do nothing wrong and defend your own home from a piece of thieving street trash, you get to go to jail. That's keeping New York nice and SAFE.

There's always more to the story. So far your idea seems the most plausible. I know New York is going down the drain fast. But this seems a little too fast.

Of course. They are just doing what they were elected to do, look out for their constituents. Big city Commiecrats cater only towards the criminal element.

To those saying there has to be more to the story, remember this is NYC. There might be more to the story but you shouldn't be surprised when there isn't. I was born and raised in NYC, the amount of anti-American garbage that goes on there can only be believed if you lived through it.
 
Regardless of his legal status in another case, this seems to be a clear cut case of self-defense and unrelated to the assault charges. I'm not a lawyer and I can see how the pending legal case probably has some bearing on how the gun charges came about.
That said, it appears that this sort of thing is indicative of how antis want this world to work. All too often I hear about how "gun violence" in other countries is so much less than here (US) without regard for violent crime numbers as a whole. I guess the antis willing to tolerate home intrusion, rape, robbery, and assault so long as a gun isn't involved.

It's not clear: Has he been found guilty and SENTENCED to three years or does he face a POSSIBLE sentence of three years.

There's a big difference.
