Subject: VA-ALERT: Improved restaurant ban repeal passes House and Senate!

----------------------------------------------------------------------

Senator Hanger's bill to repeal the restaurant ban, SB 1035, WITH the House amendment (thanks to Delegate Griffith) that REMOVES the requirement to notify the ABC manager has just passed the Senate!!!

The improved bill, which already passed the House, now heads to the
Governor's desk.

Please DO NOT contact Senator Hanger to thank him - I have already
done that for all of you. There are so many of you out there, Senator
Hanger's aide didn't want her email box to blow up. ;-)

Action item on this will follow in a day or two.

--

On the bad side, Delegate Cole's gun buy-up bill was gutted by an
amendment by Senator Stolle. Unfortunately, that version passed the
Senate.

Now we want the House will reject that amendment and insist on its
version and send the bill to conference committee.

I am working this issue right now.

There might be an urgent action item on this, but I'm not sure yet.
Please keep an eye on your emails this afternoon.

--

The Senate has REJECTED the House's attempt to REMOVE the Senate's
weakening language from the two "teeth in preemption" bills (Delegate
Carrico's HB 1655 and Senator Smith's SB 1513).

Both bills will now head to conference committee to come to a solution.

I will advise as we watch the bills' progress.

--

Good news: Delegate Lingamfelter's bill HB 1851, which exempts active
duty military from Virginia's one handgun a month law, has passed both
the House and the Senate and now heads to the Governor's desk!

Super.

How long until Taxin' Tim vetoes it like he did last year? :(

I'm sorry, I should be happy. It's just I know that it is doomed to be vetoed and there aren't enough votes to override.

Of course, I would be very happy to be proven wrong.

I strongly suspect he WILL veto it.

But, it speaks well of the legislature that they understand what needs to be done, and they continue to put this on the Governor's desk each year in spite of Timothy Kaine's opposition.

Kaine is done. This is is his final year of being a scourge in the Governor's Office.

Each of the three democratic candidates for the November election for Virginia Governor have excellent NRA rankings. Once Kaine is gone, I expect this issue to be finally resolved.

This morning on Radio show, Kaine says he will probably VETO.

All Hail KING KAINE.....doesn't care what the people say, it's what HE says that counts. Last year of his A$$, I'll be glad when he is out.

Yeah, I heard the show this morning as well.

He cut off this woman who was upset that he accepted the DNC chair without resigning. It was rude.

I just don't understand why he thinks CHP holders concealing a gun instead of open carrying it is such a bad thing. What the hell? :cuss:

I find it interesting that my senator said "i appreciate your concern but I do not agree with you, and did not support this bill" and when I replied to him, he blew me off. Notice he did not say "the people" disagree. they do not support the people. that is why King Kaine can veto it, because he knows the legislators in this state do not actually reflect the people and their wishes and will not vote with the people, but with their own prejudices. So he can veto anything that the Messiah doesn't believe in

I don't know that I would vote the way my constituents wanted me to if I were a politician. I would likely vote the way I felt was best to personal liberty.

In my opinion, that's the whole point of elected representation in lieu of direct democracy.

That being said, Kaine is still an idiot for vetoing it last year. Though, he still has a chance to redeem himself. Doubtful.

Doc, don't feel bad, When I had sent a letter to webb and Warner over the bailout, Webb's reply said " Thanks for your input, I'll take it into consideration", Warner's reply was " Thanks for your letter, but I AM going to vote for it". Geez, at least Webb's letter made me 1/2 way feel like I had some input. You are right, they could care less what the people say.

Now I tell ya what, I would respect the hell out of a politician that made the statement " I was absolutely against this bill, however the voice of my people said vote for it. So I did."

ATA, that is what they are supposed to do. as VOICE of the PEOPLE. Not have the attitude "people voted for me, so I could decide for them", they should decide WITH them.

I respect Kaine's authority to veto any legislation - it's an important part of the checks and balances. However, it irks me to no end that he will restrict freedom based on something he's concerned might be a problem, two times in a row. If the restaurants don't like guns on premises, they already have the authority to hang a sign out saying so, and that's their duty as a responsible citizen. Same thing with the smoking ban - Kaine should tell the restaurants to act in their own interests, themselves. As it is, he trusts me to carry a gun in the State Capitol building during lobby day, but not a restaurant that serves alcohol.
