Got myself in a pickle. I paid a tax stamp to SBR a dedicated 9mm AR lower about a month ago. Now I just got word that a CZ Scorpion just came in for me. I wished I would have saved the $200 and put the stamp toward the CZ.

Is there anyway to cancel the Form 1 and have the $200 refunded?

Your best course of action, in my opinion, would be to call the ATF, NFA division, and ask them.

I would expect voiding a form to be fairly easy.......the refund on the other hand????

Be sure you are aware of the problems with the Scorpion magazine before dropping more $$$$ into one.

All you have to do is ask.
You can even get a complete refund after the stamp has been issued.

I would just put down $200 more. The wait will be long enough without trying to confuse them.

I don't really have a need for a 9mm AR and CZ Scorpion both.

What is supposed to be wrong with Scorpion magazines? I have 2 x 20-rounders and 2 x 30-rounders and they have worked fine so far (only a few hundred rounds).

Did some searching and couldn't find much on problems either.

The feed lips are breaking on the scorpion mags.

Last week (7-15) a friends form 4 was cancelled for a mistake he will be refunded his $200 in 2/3 months per the letter included with the returned form4. As of January 1st 2015 all mistakes on paper forms get cancelled and refunded and you have to make the corrections and start over,no holding your spot.

I've seen some reports of feed lips cracking but supposedly even then they still run okay. I expect that there will be US-made after market magazines eventually too.

Forgot his form was stamped in red with Cancelled No Action Taken. So he can't use the same form and has to get the Cleo to sign again which is very hard to do here.

I called them and they can't do an amendment to change the firearm on the Form 1. They can do a cancelation, but you have to send a fax or mail a letter with the request. They can't do it by phone. I'll be making the fax on Monday morning.

I know if there is an error and you don't fix it in the time given or if you do it online as an Eform they will cancel it and refund you. I would imagine you can just call and ask they cancel it. HOWEVER it is the government and their filing system is not the most advanced. I saw pictures once and it was literally boxes upon boxes of files along the walls of he building. It was unclear if those were un-enveloped and stuffed in there or if they were cataloged somehow. I would imagine and hope they were.

I never got my refund, had to sic my bank and MasterCard on them. Bank did their thing and credited me the next day. Through their investigation they stated that BATFE would not return their calls, or letters. Just an FYI if you expect them to refund your money, at all.
This was a form 1 that I screwed up with the obligatory rejected refund in process so I accept that I need to have my poop together and it wouldn't have happened but that's no relief to me getting my refund.

They won't do a cancelation by phone. You have to mail or fax a request in writing attention to Kim Ramsburg. I did yesterday so I'll watch the status of my application. I guess worst case scenario is I can call my credit card and dispute the charge.
