They are both 7.62 Nato, but the M24 was originally chambered for .30-06 and the action was never changed to the short action. One of the possible reasons for this is that the long action would allow for future conversion to .300 win mag.
There's nothing in the CMP charter that would prohibit it. They are .30 caliber and non-automatic capable.
The question is will they ever be declared surplus to needs? Or will they just be used until completely worn out and either rebuilt or scrapped? No way to tell.
Personally, I think the "used until worn out or scrapped" is most likely, but you never know.

That is what I was thinking that one of two things would happen. Eventually they would be worn to the point where they do not meet service standards, but are perfectly fine for occasional civilian shooting (after a new barrel perhaps). Or, the military would choose to replace them with a new model (like the XM2010) and would declare them surplus as is. I would think that CMP could get a pretty penny for these things. I know I would be sending my order form in as soon as they started accepting them.
well, it takes a looong time to wear out a rifle, odd are that they will rebarrel it, for .300 win mags for the M24 from what i now know. the M40's will possibly be available, but odds are they like their 7.62 nato, and will keep it.
but... possible, i would love to own one, but i think m next rifle will be .300 winmag or .223
