The U.S. Supreme Court will make a decision regarding whether to hear the case of a Fredon man’s quest to carry a handgun outside his home in the coming days. This morning, the court has scheduled a conference to make a decision whether to hear the case, titled Drake v. Jerejian.
Lawsuit namesake John Drake said the court should decide by tonight whether to hear the case, but he has been told the decision might not be made until Monday. “Sometimes a decision is not even made on Friday or Monday,” Drake’s attorney, Alan Gura, of the Alexandria, Va.-based law firm Gura & Possessky, said on Thursday. “It is possible that they don’t make a decision and re-list the case for the next conference.” The next conference day is scheduled for April 25.
According to SupremeCourtHistory.org, when the justices convene this morning, “the Chief Justice opens the discussion, summarizing each case. The senior Associate Justice speaks next, and comment passes down the line. To be accepted for review, a case needs only four votes, fewer than the majority required for a decision on the case itself.”
