1) Violent crime with a gun (robbery, rape, burglary) automatic min sentence or multiplier to sentence
2) Owners of a gun that is left out and used accidentally/maliciously by a child to harm another or themselves is charged with whatever the crime would have been (manslaughter etc).

The problem I have with most gun control laws is that they punish the law abiding while doing nothing to stop violence.

Putting away violent offenders will stop most violence.

Putting away irresponsible gun owners will reduce accidents.

reduce/eliminate most drug laws and release drug only offenders.

Enforce what is out there. I can not think of a single new gun control law which we need now.
Should be getting rid of laws, not passing new ones on technology which is 100's of years old.

Nope

Instead, I would like to see repeal of these laws for starters...

1968 Gun Control Act
Lautenberg Amendment
GFSZ
Hughes Amendment
NFA
Import Ban

And repeal whatever else that is an infringement on the Second Amendment
.

I agree with NO gun control laws. Not one of the 22 plus thousand on the books. As the cliche goes, GC only hampers law abiding citizens.

Criminals and loons don't pay any attention.

No. Why should the tool used by the criminal change the sentence? A rape or other violent crime should be severely punished no matter what weapon the criminal uses. Are you seriously saying that a rapist should receive a lighter sentence because they used a hatchet to commit a rape instead of a handgun?

In theory, I have no problem with this. In practice, I'll bet that law would be severely misused and mis-applied. It's the same way that I have no problem with UBCs in theory, but in practice they are often ridiculously restrictive and require registration to be fully enforced. And as a result, I'm firmly against UBCs.

no. personal responsibility should not have to be legislated.

And second, judges should have wide discretion in sentencing, otherwise what is the point of the judge?? Bc of this, I do not support any automatic multiplier / extension to the sentence.

Start adding up how many gun laws you live under at the federal, state and local level. Then tell me with a straight face that we need another gun law.

I'm not for any additional gun control legislation.

However, it should be noted that people who negligently leave firearms out and then accidental shootings occur, are often prosecuted.

I can't go into a great deal of detail at the moment, but we are prosecuting a case right now where a 4 year old got ahold of his father's gun and killed himself on accident with it.
Both he and his wife have been charged with manslaughter.
I will update when a verdict or plea has been reached to let you know how it went.

I'm not saying this happens everywhere, but it certainly does happen.

By that logic we shouldn't have any laws.

But as it says on the Index Page:
In the Legal Forum we try to understand what the law is (including court decisions and proposed laws), how it works, and how it applies to RKBA issues. We focus on the way things are – not the way we think they should be....

So let's not be going down this rabbit hole.
